Bankruptcy and recent credit

Long story short I've had a horrendous first year of marriage husband left after a couple of months, had depression on and off for fifteen years, skipped back in to high functioning depression been awful with money and just borrowed and borrowed to pay off the borrowing and left myself constantly short. Tried to fix debt with more debt. I've filed for bankruptcy and it's been accepted (just last week) but my most recent Craig is within the last month. I'm worried that this may be looked at as fraudulent? One creditor rang me today and when I explained unfortunately I just can't keep to the agreement sh tried to quiz me and wanted me info aside from the bankruptcy number. I'm now in an absolute state and feel constantly sick, not had my interview with the OR yet. I'm petrified I'll be pursued for fraud, I no I've made some horrendous choices recently but that was never my intention, and I'm not sure how I've managed to keep my job given all I've had going on. I'm now scared that I've takes charge of my finances instead of defaulting and letting the CCJ's pile up and might end up with a prison sentence. Someone give me some guidance I'm not far from throwing the towel in.

    Hi.... Sorry to hear how you're feeling.

    Unfortunately I can't give any advice on bankruptcy but I seen your post and wanted to offer some words of comfort. Don't throw in the towel just yet. Everything will work out. There are vast amounts of people on here who will be able to reassure you and advise on the right thing to do.

    Do you have anyone close to you that you've told your situation to?

  • I wish I could but my family have a lot going on as well and I can't burden them with this, they think everything is fine, aside from the divorce etc! I can't disappoint them again and tell them all this! I've been in financially difficult when I was young and you'd have think I'd learnt then. But I think the medication I'm on numbs a quite a lot of my common sense, I have periods where I'm really lucid and think !!!!!! am I doing and then other days where I throw good money after bad. Thank you for your kind words though. X

    I can understand not wanting to worry your family, I haven't told mine but you wouldn't be disappointing them. It's good to talk to someone so at least now you will have this forum. If you want a private chat feel free to message me :)

    Have you looked at the bankruptcy threads on here?

    To stop you getting into further debt why don't you post a statement of affairs SOA can be found in the sticky thread. Post the results on here and we will be able to spot where you can save. I did it last week and I've already been able to save £££'s per year.

  • Thank you that's very kind. I know what I need to do now I've sought advice and reading forums on here has really helped. I'm just so scared of getting in to trouble for fraud even though I know my circumstances are probably very common. I'd loose my job if that were to happen so I'm catastrophising now as well ��

    Ok well it's not going to help getting yourself stressed (easier said than done I know) but take it day by day and deal with any issues IF they come up. Hopefully someone will be along soon who knows more than I do :)

    You're unlikely to have any problems. You are not going to prison.

    However, stop talking to your creditors. The only person you need to talk to now is the official receiver.

    You've got a new start. Keep posting on here. Maybe start a new thread on day-to-day stuff

    Another not wanting to read and run really - listen to Fatbelly though, he knows about this stuff.

    You said it yourself - you're catastrophising - so take the steps through that to deal with that behaviour.

    If you get any more calls from creditors simply tell them that you have filed for bankruptcy and that all further dealings will be via the OR. Tell them that they are NOT to contact you via telephone any more. Then hang up. Make a note of the number they call from and block it on your phone if possible.

    Well done for managing to maintain things with your job and for being brave enough to take the plunge re the bankruptcy too - from here on life gets easier.
