Of course OP needs to move Banks, otherwise all income will go straight to Shabbey, and compound the difficulties. Also, they have to eat, get to work, and basically live for a Month. I really don't care what is in T&C's, or how lovely Banks are, leaving a person with children virtually penniless for a Month is totally immoral - OP has made what, on the face of it, looks a reasonable offer to repay at £100 per Month. Much of the debt is charges that may yet prove unlawful (Fingers crossed), and I hope OP will be trying to reclaim these once the Court finally rules. Never lose compassion and humanity, one day it may be you with the problem.0

a - In the first post.
b - I have read OP's post on the debt-free forum, and there does not appear to be much slack. Point I was making is that OP then has little income left for all of the other bills, which if Unpaid causes much hassle and cost, and the necessities like food etc.
c - OP has 2 children - If most of income goes to Abbey, it does not leave much available money, but 'penniless' sounds nice and dramatic.
d - I grant that this is a bit of an assumption from Post 1, based on the fact that the only thing Banks allow once over-limit is their own charges.
Cannot comment on your last point, all I know from other posts is that OP is trying to sort out their finances, and with the right help and self-commitment, this is achievable. Personally, I would have thought £100 pm is reasonable, after all, OP cannot pay what they don't have.
I have been in a similar position to OP, and I had a condescending lady at RBS telling me that, as I had incurred over £700 in charges, I could not draw out any of my next salary, and that getting to work and feeding 2 young children was 'my problem'. Well I moved my salary elsewhere, so it became 'their problem'. And I could not pay in installments, because that would be a loan, and because I had gone over limit (Mostly due to charges!), I was not eligible for a loan.
There you go Tootsie Roll, facts with a bit of posturing thrown in for good measure!;)
AlMac - Banks in the late 70's were great, we loved our customers, looked after them, gave them cakes and coffee and were just so wonderful. Suit and tie by day, and punk rocker by night getting our Teenage Kicks!:eek: Not like these days..........:p

Open a new account as stated above.
Although all banks are awful the awful Barclays do a card cash account that they give to almost anyone (thats assuming that your credit record is not much good) It allows payments in and DDs out but you can not use it in shops for chip and pin etc you have to draw the money out from the machine or go into the bank.
Not such a bad thing really because it limits your spending.
Set up a dd to the Abbey for the £100 and see what happens. You will be making payments and thats that.
Also reclaim the charges.
The consumeractiongroup is brill for this sort of advice.
The people on there really helped me with reclaiming, although I didn't need to open another account as it was not the same reason as yours that advice was given over and over.
So apply for a normal account (you never know ) if they say no they might just offer you the card cash one.

Well many thanks to all of you for your advice.Well nearly all.
I have opened another account with the co-operative bank. also found out on the cag website that if i put a claim into the courts for the charges abbey cannot issue a default as the account is in dispute. So will be doing just that.Make £11,000 in 2011 / ebay £6000
