Is this ok?

From our debts one of the creditors has said they need a settlement or a ccj will be placed on our house.....obviously we don't want that. They have said we can make a standing order of an extra amount monthly to ensure the debt is repaid within ten years. We are happy for this and could manage it. Would the other creditors become aware of this and do we need to contact SC? Thanks in advance.

  • Hi exactly the same thing happened to me with Nationwide, we were paying them the extra then SC found out, and said they would cancel our DMP. But there probably are others on here who have done the same thing, and not had any issues. Good luck whatever you decide.

    A creditor cannot apply for a charging order on your home without a CCJ in place first. If there is no CCJ this is most likely a scare tactic. And if you are in a free DMP with Step Change I would suggest talking to them before amending your payments.


    Paying a disproportionate amount to the debts is a preference payment and, if other creditors become aware of this, they may no longer agree to negotiated offers (as they are not fair) and may become more aggressive in going to court themselves. It is also possible that SC would cancel the DMP. Remember no DMP is legally binding and court action is always a risk, but you should talk to SC about your concerns and potential solutions.     Just clarify this for me.

    A CCJ is a county court judgement, basically an order of the court, i think you are talking about a charging order, as ND says, they need a CCJ in place first, before a Co can be applied for.

    Do you own your home jointly, or in just one name ?

    Dont let creditors bully you into breaking the terms of your DMP, and dont think that because you owe them money, they have any more right to dictate what your actions should be, they dont.

    I would send a strongly worded letter putting them back in their place if it were me.
