Debt Help and Full and Final Offers

Hi All

I'm in a situation where i think i can make some steps towards becoming debt free and would like some advice on how to approach it.

The current situation is as follows;
118118 Loan = £4,000
Barclays Overdraft - £2,000 (Moorcroft)
Barclaycard - £1700
Mr Lender Paydayloan - £1,008 (SLL Capital)
Lending Stream - £882 (ACI) CCJ Issued, have acknowledged, submitted CPR and CPA requests and seeking advise on legalbeagles.
Luma CC - £900 (Lowell)
Vanquis £750

If there isn't a Debt Collection Agency in () then it either hasn't been passed on or i haven't heard in such a long time i've forgotten.

So the CCJ claim has been filed, looks like i'm going to lose as they've provided all the documents, etc and i don't really have a defence....

On more positive notes, i've received some decent commission at work i would like to use as Full and Final Settlement offers to clear as much as i can ( I hope to be able to clear all the smaller amounts off, leaving just 118118 and the two Barclays.

I had recent letters from Lowell and SLL Capital, Lowell were offering 30% Discount and SLL 50%.

I've sent a letter to both, offering 25% to SLL and 30% to Lowell.

The response back was SLL refusing and sticking to there offer of 50% and Lowell refusing and offering 50%

What should my course of action be?

Also, i haven't heard from Vanquis in such a long time? i'm not sure where this debt currently resides, would it make sense to leave this alone until i'm contacted?

Sorry for the messy post, appreciate this might be a slight ramble but was typing as it all came into my head :)

Any advise appreciated!

    Before you offer full and finals, if I were you i would cca the ones that have been passed or sold to debt collection agency, if they are offering you a decent discount then maybe they don't have the correct paper work,

    As for the one that has took out a ccj against you and you think they will get it i personally would try and get this one paid off if you have the money to, as you don't want a ccj on your credit file

    that's one of my questions on Legal Beagles, i stated my intent to defend my claim - i'm not actually sure how to cancel this and accept the amount and pay?

    I had the same thought as Max. Why not hold on to the money for the moment and see if they get the ccj

    If they do, then provided you pay it off within a month it does not get recorded on your credit file.

    The cca idea is good too

    I have about £1,700 to put towards debts, if i can get the right level of F&F's i hope to pay the CCJ and the others.

    I'm not sure how to cancel my intent to defend on the CCJ and pay this, i might call the court.
  • I had a debt with Vanquis and so did my Husband - he was getting regular letters from them with statement updates and payment requests while i was getting nothing.

    We decided to contact all of our debt companies to offer F&F figures and it turns out my debt with Vanquis was SB so they just wrote it off, which i why i never received anything from them. I got them to comfirm this is writing in case it creeps up again in the future.

    My Husband's Vanquis debt was still ongoing and had actually been passed to Lowell to deal with - they we very easy to deal with and accepted a 35% reduction as F&F. We probably could have pushed for a lower amount but we were happy to get anything off , we make the payment on Friday as will then be debt free :)

    Thanks Cheryl, think i'm going to sort the CCJ one out (if anyone can tell me how to pay, seems mad but i've been going round in circles trying to find out if i need to do anything to cancel my intent to defend?!)

    Then i'm going to pay SLL Capital as they've offered 50% off, and try get 50% from Lowell

    That leaves the three larger debts and Vanquis, i will put the larger three into a self managed DMP and save some money for full and finals i think, i'm considering ignoring Vanquis and when they do appear then negotiate?

    If you want to, you can just pay it, then inform the court it's paid.

    But if you've got anything going as a defence, why not wait to see if it works?
