Working Notice Period and Going on Sick

Hi
Need some opinions please, really not sure what to do.
I have worked for my company for 8 months. They are relocating about 30 mins away in Nov and I have decided not to move with them so found another job locally which I start on 18th Sept.
I handed my notice is on 15th Aug and asked to finish on Fri 8th Sept, (3 weeks notice) however they have said no and I need to work until Fri 15th Sept, they have put this in writing to me.
I really would like a week off before I start my new job. How wrong would it be to have a week on the sick.
This is something I have never done before and would like some opinions.
Thank you in advance for your replies.

very very bad to go sick if not sick.
What notice is in your contract?
4 weeks would have your last days as the 12th, One month 15th0 -
Its up to you really.
I mean with contracting and temp work its really up to the worker they can give as little as a couple of days notice. Which I have done before.
Saying that many years ago whilst In a permanent job I have left same day when it didn't work out and I was still on probation.
I would say it depends on your relationship with your work/managers.
Three weeks sounds adequate and I would say a little unreasonable on their part not letting you do that. Then again I don't know how much an inconvenience it is for them.
As for the sick you can self certify for a week I think without a doctors note so there isn't anything they can do.
Hope it helps.0 -

I think you know the answer to that!
I assume your contract requires a month / four weeks notice as statutory notice is only one week?
If you have any holiday owing you can ask your employer if you can take that as the final part of your notice. They are entitled to say no but then they would have to pay you for those days after you leave.
Often, if you make it very clear that you are keen to leave earlier an employer will agree. Most accept that there is only limited value in making an employee work when they really don't want to be there.0 -

They'd be quite within their right to inform your new employer of what you think is acceptable behaviour considering you've already been told they want you to work that week.Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0 -
You could just tell your employer up front you won't be turning up on that last week, and don't expect to be paid for it.
Technically, this would put you in breach of your employment contract. But it is difficult to see what "loss" the employer would suffer - especially if the employer doesn't have to pay your salary for that week.
The reality is that if you went off sick there is very little they could do about it. Other than give you a bad reference I suppose if the person giving the reference got upset. Everyone will know that you weren't really sick but it is difficult for them to prove it.0 -
Thank you all for your replies. In answer to your questions.
Yes my employment contract states I need to give 1 months notice.
There is a graduate starting next Monday to learn my job, even thought I will train him for 3 weeks, they are still refusing me to finish 1 week early. There will be no financial loss to the company with me finishing, my role is general admin.
I have no holidays that I can take.
It does not make sense to me why they won't let me finish a week early.0 -

Maybe they have that old fashioned idea that if you freely enter into a contract you should stick to it?0 -
In theory they could dismiss you for gross misconduct that week. As above the issue is references really.“I could see that, if not actually disgruntled, he was far from being gruntled.” - P.G. Wodehouse0

Perhaps there are people on holiday at your old place as you've enjoyed time off to have no allowance left and, perhaps, you wouldn't appreciate starting a new job yourself with people saying nice to meet you, I'm of to the Caribbean tomorrow for my holiday, I don't have much time to show you anything. My last new employment was to cover 3 out of 4 of the department authorised to go on holiday at very same time, unbeknown to me, I only wish I'd said I'd had to give a month's notice in all honesty.
If you ever need to ask your old employer for a job back, you'll be glad you worked that extra week.0
