CCJ sent to fathers adress

Hi everyone, need some help.

Just had some county court papers sent through to my fathers address, not lived there for years. Trying to take me to court for debt 5 years and 8 months old, so companies buying up expiring debt :( Its for £2.4k.

Just seeing what the best course of action to do, have till the 20 something of august to respond to the county court letters. Seems unfair trying to get the judgement at my dads address and haven't heard anything for years.

    Well, did you provide them with a new address after moving away from your dads? They have to serve at the last address you've provided them, not any else.

    And if you owe the money then your best course of action is to contact them and figure out a payment plan to settle the debt. Or if you have enough money to pay it off, negotiate that - this way you can avoid getting a CCJ on your file for 6 years altogether.
    Unless you and the debt are in Scotland, in which case the debt is statute barred as the period there is 5, not 6 years.

    Arleen is correct about the serving of the claim forms, they will only be sent to the last known UK address, so unless you can demonstrate that you had informed them that you had moved, there wouldn't be much you can do about that.

    The good news is, that you are aware of the claim forms so you can deal with them. You have 14 days to reply from the issue date, plus 5 days for postage if they are from the Northampton County Court / Business claim centre. It can be frustrating when claim forms turn up near the limitation period, however, if you don't dispute the debt for any other reason you need to complete the Admission form within your response pack. You must reply within the deadline.

    Make an offer to pay, and send it to the 'address for sending documents and payments' as shown on the particulars of claim. Send your response recorded delivery and keep a copy. It is unlikely you will have to attend court and should just get another letter outlining the payment structure of the judgement. You can ask them not to enter the judgement in favour of a payment plan, but unfortunately, it is unlikely they will agree to that as they have already paid a fee to raise the claim.

    If you pay the judgement in full within 1 month of the judgement date it will not be recorded on your credit file. If you are unable to do that, then it will show for 6 years from the date of judgement. As long as you don't default on the judgement the lender will not be able to use bailiffs or apply for an attachment of earnings order to enforce the debt. Best of luck,

    Just elaborate on the timescale of the debt please.

    What type of debt was it ?

    what date did it default (look on your credit file) ?

    when did you last make a payment to this account ?
