Ok so i recently sorted myself out alot. I checked my credit score on noddle and it says theres a CCJ from 2012 for £4000. I have no idea which company i owe at the moment i remember it changed alot over a year or 2 but i havnt had a letter for a long time and stupidly didnt keep them. The debt is from a student overdraft of 3.xk so i have no idea how the debt ahs got so high, i remember alot of it origionally was bank charges, not sure if i can do anything about that now? probably too late.

I would like to get this sorted but have no clue where to start. A friend said they accept lower offers than the actual debt if i could pay in a lump sum but that doesn't sound true to me, plus i dont know who to speak to regarding my debt in the first place!!

I really want to clean my record and start building up my rating. It has gone from 1-2 since getting my 5k car loan and credit card i use once a month and instantly pay off. Is there a post with more tips on improving rating quickly? My work is 100% guaranteed for many years so i really want to sort it all out and can afford to make payments.

Sorry if the post is a little jumbled im trying to get all the info in but dont know what is relevant lol :) Ty for taking the time to read.

Jamie.

    Hi Jamie

Welcome to MSE. Your credit file will tell you which court made the CCJ, you can contact them and try and get the details of the original claimant. If the debt’s been sold on several times you would need to check with each company until you find the current owner. Challenging the balance of the debt now will be tricky, you’d really need to find out whether the interest and charges have been added as allowed within the terms and conditions of your overdraft agreement before doing anything.

Offering a reduced lump sum towards the debt is a possibility, although maybe less likely because they have a CCJ. But if no payments have been made for a long time the prospect could still be attractive to a creditor. If you contact them and they don’t accept your offer you may need to make an offer to pay the debt in instalments. If you’re not paying a CCJ as the court directed they can take enforcement action such as using bailiffs. If they won’t negotiate a payment plan you can apply to the court to agree to one.

Another option is to do nothing. The CCJ will drop off your credit file after 6 years. You’ll still owe the debt but there’s a possibility you may not be pursued for it. And after 6 years have passed a creditor will need permission from the court to enforce it. With regards to your credit score, the best place to post is in the Credit File & Ratings forum.

    Is that 100% definatly true?
The CCJ defo wont show on my credit after 6years? I could pay it/arrange payment if they ever get back in contact with me again that works for me if your info is right, there are alot of different things written online about a CCJ and 6years.

    Hi again Jamie

Yes it is definitely true that a CCJ can only be recorded on your credit file for 6 years. But as I say it doesn't mean you no longer owe the debt. You could either get in touch now and hope for a settlement, or set up a payment plan. Or wait and see if you are contacted. Bear in mind the risk of enforcement action while the CCJ is not being paid. However it's been 5 years and as far as we know they haven't done it so far.

    I don't know what you've been reading.

That is the course of action I would recommend. I seem to be writing a lot recently 'if it's gone to sleep, don't poke it with a stick'.

Contacting the court won't reactivate anything. They'll just tell you who it was who took court action in 2012. It is worth doing that as I've met a few people who said 'I know what this is' only to find out it wasn't!
