Advice needed - company not sending out prize

Hi,

I wanted to ask what anyone would do in this situation. (sorry for the length of the post but I need to give all the details)

I won a competition last month through Stylist magazine. It was the Nespresso hamper and tickets to the opening of the new Soho cafe.

I received a text on the day notifying me of my win and whether i would be able to attend. I called the lady back from the marketing company and explained i couldn't make it that night. She said not to worry and asked for my address so that they could send the hamper to me (coffee machine, milk frother & box of coffee pods). I gave her my address.

One month later and it hadn't arrived so i called the lady back and asked if she knew when i was to expect it. She took my email and said she'd contact me that day - she didn't. I tried calling again and emailed but she didn't pick up so i left her a voicemail. She has just sent me an email saying there was a mistake and as i didn't turn up on the evening i cant have the prize!

I've tried calling her again - but no answer!!

Is there anything that I can do?

What do the terms & conditions of the competition say? Was attendance a condition of receiving the prize?

and although I can not get specific comp terms it does say in the blurb "The winner will also take home a luxury Nespresso gift hamper, featuring a brand new Essenza mini machine and Aeroccino plus a full discovery box of capsules – as well as vouchers to enjoy quality Nespresso goodies from the caf! for months to come"

which does read to me like you needed to attend. Suggest asking the lady you are in touch with for a link to the comp terms?

It just has standard T&Cs on it as far as i can see.

It's the fact that straight away when I said I couldn't attend she said no worries we'll get it sent out to you. If she had given me any doubt I would have asked if a friend could have gone in my place to collect it for me.

I think you need to give them a chance to address this, but you will prob end up having to do an asa complaint I would also cc stylist and someone higher up in the marketing company in any correspondence. Good Luck!

T&Cs were explicit, unless you have proof they told you otherwise it might be a bit of a struggle

- Winner will receive two tickets to the event and must be available to attend event at Caf! Nespresso in Soho on the evening of Tuesday 11th July. If first selected winner is not able to attend, we reserve the rights to select a different winner.

- The event will take place at the new Soho Caf! Nespresso, Broadwick Street, Soho – all the details will be revealed directly to the winner.
