Issue with Holiday pay from being dismissed from last job?

Hello everybody,

My current situation is

I've worked with a employer for over a year, to be authorised to work on the contract I need the correct valid working passport. It cost somewhat between £950-1250. My employer claims he paid for it himself to authorise me to start work.
It was all so stated I would be earning £17,000 per year, but this did not happen as he claimed I was not up to scratch and only paid me £1100 a month. I asked for a pay rise a number of times but didn't happen, I eventually got sick and tired of asking. Only I was traveling 50 miles and back a day in my own car where everyone else had a van. I got giving a written warning for being late where it wasn't my fault as coming in very busy traffic where as if I was in a van I couldn't be blamed.

I found the another job with a different employer, who is paying me more and I'm being picked up for work and when I turn 21 I will get my own van. I told my boss ( at the time) I've found somewhere else, he was okay but basically sacked me and said he can't have someone on knowing they are leaving. Luckily enough my new employer was happy to take me on quicker.

I have just messaged my old boss about my holiday pay I only used 4 days out of 28 (inc bank holidays). He said no because I owe him money for training. Where he underpaid me, and breached the contract already.

Has anybody got simlar experience where employers say you owe them money? Been underpaid for a whole year with no change and constant lies?

I really appriacate any help in the comments

    If you worked there over a year, then what was the holiday year, because 28 days appears to be a full years holiday. And one way or another, that doesn't sound right - at some point in the year there would have been an end to the holiday year, and if you didn't take it, you probably lost it!

    What kind of passport costs £1000? Are you in the UK or somewhere else?

    It'll be something specific for his job like builders need the CSCS card to work on construction sites.

  • Yes, something similar to a cscs card. We call them authorisation codes or working passports.

    Assuming you are in England or Wales, then he can only deduct training costs if you agreed to this - did you sign a contract, and if so, what did it say about training costs?

    Did you ever sign a separate agreement about training costs?

    What training did you have, and how much did it cost? Was it training that was necessary for you to do your job, or anything which gave you a separate qualification?

    In terms of his underpaying you you, I don't think you can do anything (unless this took you below NMW) as by continuing to turn up for work you accepted the change to your terms.

    But you should be able to reclaim the holiday pay.

    The holiday pay owed. The OP had worked over a year. That means we are talking about two holiday years, no matter how you cut it. Unless the employer is incredibly generous, being owed a full 28 days is unlikely. Any holiday not taken in a previous holiday year is lost, unless they have had permission to carry it over. Use it, or lose it.
