Sold car.. potential problem?? Help!

I am hoping you can help.. due to numerous events beyond my control I am possibly looking at bankruptcy. My worry is this.. sold my car (worth about 9k) to my mother just over 1 year ago, she paid me in instalments as she didn't have the full amount at once. I used the cash to live on while I was on maternity leave (being a single parent who receives no maintenance and considering the SMP isn't even enough to cover rent!!) I am really worried that if I declare the sale then they will try and take the car off my mum and sell it on again to pay my creditors. She's my mum therefore I did no receipts or anything like that but she paid for the car fair and square, sadly I cannot prove this!! Besides, I didn't exactly plan on going bankrupt so I genuinely didn't think there was a need for receipts and proof etc. Or even if the OR will ask for it? Thanks

    I did almost the same, don't worry about it, just tell it as you did here. Sold car - spent the cash received on living.

    You don't have to say who you sold it too or that they paid in instaments unless specifically asked, I wasn't.

    Is the car on finance? If so, this provides a totally different problem.

    If not, then the official reciever doesn't even need to know about the car. Just get your mum to pay you in cash for a year.

    Assuming the car is not on finance...?

    If you sold the car for a sensible market value the OR will be fine with it - however, if you sold a car for much less than it was worth (for example sold a 20K car for 9K) then the OR might be more inclined to look a bit a bit harder at the transaction.
    Other wise just tell the OR you have been living on the proceeds.
  • No it wasn't bought on finance it was a gift from an ex so I never actually paid for it
  • But then do you have to prove how much was paid? As I said 9k was a fair price but she paid in istallments which I know isn't the norm but because it was my mum I agreed because I knew she would pay!

  • Oh dear me. Not that I should have to explain my situation to anyone.. but seeing as a moron such as yourself decided to pipe up here goes.. I am a highly qualified professional who happened to fall pregnant (which in your book is obviously a crime) and seeing as my no good useless ex left me high and dry I had no choice other than to take a few months off to look after my baby... If it was up to people like you I'm sure there would still be workhouse and people like me would be thrown in them?? I have had highly paid jobs in the past and paid more than my fair share of taxes so don't you DARE judge. You are vile.
