Id issues

Ok my birth certificate shows a different surname which my father changed under SCOTTISH law when I was a toddler which means in Scotland just informining doctor, work, bank etc of name change.

Never been a issue apart from when I got passport 13 years ago needing a letter from father stating the name change.

Now passport has run out I attempted to use birth certificate as official id but its not accepted due to name change.

Just checking if that was correct, I could change the name but its £40 to do so and £15 for a new copy.

You seem to have presented a problem and finished with the solution.

If you are using it for employment to show that you have the right to work in the UK, then an expired British passport is OK. If the employer says it has to be current, ask them to check the gov website.

Does the employer want the birth certificate for a different purpose?

Think it was, and probably still is, English and Welsh law that you can simply start using a different surname.

They said no, wasn't just for employment but also job coach systems.

    Friend had same issue.

I have been told over the years its by deed poll.

Ask them for more information about what is required. Who requires it? I really can't see why "job coach system" require more than right to work. Unless you are a job coach.

A friend with a different birth surname and nothing to document a change?

Can be - and some organisations will require deed poll but not strictly required as long as it is not done for fraudulent purposes.

No friend had an outdated passport and interviewers refused to accept it.

The job coach/agency team say its for ID purposes and they can't accept anything out of date and its a legal requirement, other places say its for ID requirement.

I don't think your father has changed it under Scottish law. I've changed my name under Scottish law and it involved applying to the registrar general for Scotland and having a new birth certificate issued in my new name with a note of my old name and birth certificate number in a box that doesn't appear on my husbands certificate.

It sounds like your father changed your name unofficially and it's been your accepted name until companies have got stricter with proving that they have checked that their employees are legal to work in the UK. If you're still in Scotland I'd suggest getting your name changed properly and going from there.

It was changed 30 years ago, so I assume things were different then.

The only issues I ever had was when I got a passport I needed father to write a letter to confirm the change of name, even my NI card came in my current name when I was a teenager and been claiming benefits no problem with this name.

I did check the name change and the cheapest was £55.

It's always been the case in Scotland that a whole new birth certificate is issued. You can go by another name but that doesn't mean it's been changed under Scottish law

Its a strange one then as we had solicitors back then recommend dad do it that way (I was too young to know) who dealt with my family until I left home due to trust funds and all that would of thought they flagged it up at some point.

All I know is my dad changed name when my gran died, no idea if it was part of her will

I had no problems recently when applying for a provisional but didn't go through with it in the end, and my passport is in my current name.

Either way its cheaper to get a driving license than change my name on birth certificate!
