Payment for loss of earnings help?

Good afternoon

Hopefully sombody is able to shed some light for me.
I was involved in a car crash yesterday,i was at a holt and was hit from behind the other driver has admited liability and there insurance company rang me yesterday before i had left the scene to say they are admitting liability ect,now iv been off work today and may need a few more days off as my kneck and back are really hurting but im worried about money as i dont get sick pay.does anyone know for the days off will i be able to claim back loss of earnings?

    Why don't you get sick pay? What is your employment circumstances?


    Typically an employee can claim back any money they've lost out on

    Might just be referring to the first few days sickness when SSP is not paid.

    Thankyou for your reply, i should have made it more clear sorry,im able to get ssp but im work dont pay sick pay or what i would esrnper day ect hope that makes sense? And answers your question

    It would if it was in English:) luckily I speak predictive keyboard, having a similar condition! Whatever your loss is should form part of your claim against the other driver. Just make sure that the insurance company know what the difference is. They will also need confirmation from your employer. Obviously, it will only happen when the claim is settled. So it doesn't help right now.

    Ps. This happened to me. Do not assume you will be ok in a few days and make absolutely sure that you see a doctor. No toughing it out or assuming it's just a bit of a bang. Whilst some drivers may exaggerate whiplash for their own purposes, if you get it it can be really bad, and it can last a very long time. It can cause damage to the spine. Don't ignore pain in your neck or spine. Get a doctor to tell you that your are being ridiculously paranoid and a hypochondriac. That way, if they are wrong you can sue them too!

    And keep receipts for any medicine etc. Even prescription charges. You will be able to claim it all back.

    Also im having to go for medical appointments so will be finishing work esrly so pay will stop again,to my understanding this will still be classed as loss of earnings due to the accident so again will be able to get that loss of wage back?

    All loss of earnings which can be attributed to the accident should be reclaimable from the other party's insurer. That would include time off for medical appointments. As sangie said, your employer will need to provide evidence to support your loss of earnings claim.

    Yes. It is quite common as well, at some point, for you to see a medical practitioner appointed by the insurer of the other party. It isn't an attempt to trick you or anything. It is usually once you are as "fixed" as possible, and to confirm any possible lingering affects that may need to be compensated for. In my case it was at about six months after the accident. But I imagine that depends on how serious the injury is. In my case I was off work for two weeks (which is an awful lot for me) and it took the best part of three months before I would say I was totally ok.

    Yes. Whether / how much time off work you will need depends a lot on our job - I only took a couple of days off as I could be in pain at work just as easily as at home, and the advice I was given by the doctor was to keep as mobile as possible, although I did use taxis to get to work for a few days as I was not able to drive, and if course if your job involves physical work you my not be fit to work. as k your doctor about when / if you need to be off
