Help with court papers

I have just been given papers from sheriffs office from capquest for a debt I owe from 5 years ago what should I do

    Well, first we need far more detail (And probably best to start your own thread).


    1: What is the claim for, value, creditor etc?


    2: As you're in Scotland, the Limitations Act is 5 years from last payment or acknowledgement. Has it been 5 years since you last paid anything on this debt? If so, you have a legal defence.


    3: Talking about defences, is the debt CCA regulated? (So no to things like Overdrafts, Utilities, Taxes and Mobile Phone contracts), if yes, have you either sent, or have been given the CCA agreement to prove the debt?


    4: The papers received, what date must you reply by?
