Self employed but income from one source

I don't get maintenance from my sons Dad. I've never pursued him through the CSA because he is self employed and normally his payments come from a variety of sources. I know that the CSA would be a waste of time - especially when I read on here that there are fathers who are employed and the CSA can't deduct money from them. :rolleyes:

Now, it seems my ex has landed himself some regular work for the next 9 months. 11 days out of every 14 and the payment would come from the same company and I know that they ask for his NI number when they pay him. This sort of work pays between 80 and 120 pounds per day.

What would be the chances of CSA getting anything out of him?

  • If he is still classed as a sub contractor then the employer will not deduct money from him.
    However the rules for being classed as a subbie changed from April and as such it may be that even if they do not dedcut money you could have a word with HMRC to see if they will investigate his employment situation with them.

  • Hi The CSA can obtain the details from inland revenue - The problems start if he isnt declaring his full income but it is worth a try surely and if u arent getting anything at the min it wont do any harm?

  • The CSA can only get info from HMRC for the last set of SA accounts submitted which could relate to 05-06 at present, assuming he files them on time.
    Its form 721, but they have to exhaust all other avenues first. The contractor does have a duty to supply the info when requested, such as payments made to the NRP. If you know who his accountants are then they can be forced to supply info that they hold.

    Thanks for the replies.

    I know very well that he will not declare all his income and is very likely doing his accounts himself. Knowing the inland revenue they probably won't catch up with him for years and years.

    I know if I go to the CSA, he will walk away from our child.

    So in all likeliness our child will end up no better off financially and without his father in his life and as useless as he is, I think it's important that contact is maintained.
