Holiday entitlement

Hi,

My boyfriend has started working a thing a company who state his holiday is 25 days plus bank holidays. He works Monday to Friday each ten hour shifts so 40 hours a week. When he went to book of a Thursday they said he must book the Friday too. He doesn't ever work Fridays, he booked the Thursday and Friday off the first time. But now when he said he wanted Monday off again they said to book Friday off too. His manager said he doesn't understand why .... so when you book a day off you get paid the same as if you were working that day, so why would his employer request him to book the fifth day off every time he wants any time off? Working on that logic his 25 days would reduce to 12.5 in theory if he had to book off the Friday every time. My only conclusion is that they are paying him holiday at a Monday to Friday 7.5 hour daily rate as opposed to a 10 hour daily rate. Can anybody shed any light on this? His contract is wrong too and states Monday to Friday day work but he does nights. Thanks in advance.

Procedurally this doesn't sound correct. Is there a union on site, perhaps a word if the manager is being uncooperative in rectifying the situation.

Does this apply to any of his night-shift colleagues, and what do they say about it ?

Is it only Mondays and Thursday holidays which require also a Friday to be booked ?
He might need to ask, rather than booing a Tuesday / Wednesday to find out.

When the Friday is booked, is it always the Friday of that week ( so 14 Aug would be also 18 Aug ), or is it the "adjacent" Friday ( so 14 Aug would be also 11 August ) ?

Have the firm clarified that the Fridays count towards the 25 days ? Does he have a "holiday calendar" ?

It might be a procedure oddity ( with no days actually lost ), because the Thursday night shift includes some hours on the Friday. I get caught out when booking an overnight stay in a hotel ; I am there for part of 2 days, but only book one day.

If he does not work the Friday then booking it off would not use up any holiday.

they may have got the holidays wrong if he works only 4 dyas a week and this is an attempt to correct it but failing to do it properly.

if the normal 5 day workers also get 25 days + 8 BH as he works 4 day weeks he should get 20 + 6.4.
  • I am not sure if there is a Union. That said I'm not sure the manager understands himself.

Yes all his colleagues even his work partner has the same and his work partner said to suck it up. As they pay him at 7.5 hours not the 10 so by refusing to book a Friday you lose out on 2.5 hours whereas if you book the Friday they will pay you 15 hours. That makes no sense either as they work 10 hour shifts.

It's any day Monday Tuesday Wednesday or Thursday and it applies to the Friday after.

He has a holiday calendar which runs from Jan to Dec.

He hasn't asked if fridays are included specifically, this only came about when he booked his first day off. That's a point though I will get him to check that the booking off a Friday is not just a procedure for the booking system. They do have day office staff who work Monday to Friday so it's possible they are trying to get their holiday booking system to cater for all types of working patterns ...
  • Yes but surely it goes on hours not days work as he works 40 hours over 4 days which is more than 5 days at 7.5 hours daily.

holidays a re done in weeks with the statutory minimum of 5.6 weeks but can be done on days hours.

he gets (33*7.5) 247.5hrs that is more than (5.6* 40) 224hrs the statutory minimum.

the issue will be that if he takes a week off he should get a weeks pay, 5 *7,5 hr won't do that.
