SOA (statement of affairs) you determine it, form should be amongst court paperwork ?

    Which DCA is it ?

All you can do is try.

    Asset Collections and Investigations.

A quick google search came up with a thread of someone that was eerily in the same situation as I am in now with a comment of yours on top.

(Google Pending CCJ advice please mse)

Unfortunately in that persons case it appears 'it was out of their hands' back then. I will have to call first thing tomorrow morning.

Make sure they back up any deal agreed in writing, before you pay them anything.
I would continue with the court claim until advised otherwise.

Is there any resource you can point to that can help me with the court claim route?

Sourcrates I cant thank you enough. Really.

Just finally do you think this is a good modification to the settlement letter template on the national debtlines website?

I am writing about the money which you are claiming on the above account.
Please consider this letter carefully as I appeal to you to take into account the situation I experience in my life. I have two overdraft facilities currently withdrawn to the limit, I have two credit cards also nearly maxed out to the limit and finally I have 3 unsecured debts such as yours currently outstanding. In totality I have almost £5000 in debt earning very little more the than minimum wage. Amongst many other things I have rent, utility bills & food to pay for out of my monthly wage with very little disposable income left over.

I can confirm that I am unable to pay the money which I owe in full but want to work together with you to resolve this issue as amicably as possible. As such I have reached out to family and friends to explain my situation and may be able to scrape some funds together.

I implore you to accept £280 as a full and final settlement of this account. I am making this offer on the clear understanding that, if you accept it, neither you nor any associate company will take any other action to collect or enforce this debt in any way and that I will be released from any liability.

If you accept this offer, please confirm that you will mark my credit reference agency file to show that the above account has been paid and closed.

I can pay the amount I have offered within of receiving your written agreement of this offer.

Please give me details of how I can pay.

I look forward to hearing from you.

    Yours faithfully

All you can do is try, but as I said before, don't ignore the claim forms, just in case they won't play ball.

    Good luck.

Velli100, sourcrates is well versed and we'll respected on these forums for their advice.

Please tell us you have acknowledged the County Court claim. This is important as it guys you valuable time.

Also, do not write off approaching one of the charities I mentioned. They are experts at dealing with debt so they all carry more weight with DCAs than an individual might.
