SSP temp worker employer ended contract

Morning all,

Can anyone help?
Woke up to a message from my employer (agency) to say my contract at work has ended as of friday last week!!! Confused as i was told it will be end of september 2017. Im currently been signed of work til 31st august and have been off 2 a week already.

I have been there 5 months along with another temporary worker who confirmed to me this morning the contract ends september.

Now the agency said they will no longer pay ssp (they have paid me one week) as my employment has ended, so to claim off the jobcentre. I asked for SSP1 form to be sent and hes advised i just send the sicknote i have to the jobcentre.

A few questions.....
Can they end my contract whilst off sick my doctor said no.
Also i was planning to go back for the last 4 weeks all being well, need the money.
Im pregnant and suffering PND
I was told it would end september from the direct company i worked for but now the agency are saying they have the dates confirmed and it ended last friday, yet the other agency worker doesnt believe this to be true as she is still there.

Dont know what to do or where to go next.

    I'm beginning to think that there should be a module in doctors training covering why they aren't employment lawyers! Yes, an employer can terminate a contract if someone is off sick.

    Is the sickness pregnancy related?

    Also, are you actually employed- are you on zero hours, or working through an umbrella company? Do you have a contract of employment, and what does it say about notice periods?

    Without the proper information it's hard to advise, but I would guess that one possibility here is that the client has terminated - if you aren't in work then you are not much use to the client! They are hardly going to want to pay for a temporary worker to replace the temporary worker they are already paying for. That is one of the difficulties of being a temp - the clients expect attendance. But we can't really help to see if you are owed anything on the information here.

    Just checking your posting history, I see that the sickness is not pregnancy related. But I do think that one thing you need to do is talk to your partner. Your debt situation is going to get a lot worse, and living with someone from whom you are keeping such a huge secret is going make your depression worse, not better. You are clearly in trouble and need their support.

    If an employer is finishing the payment of SSP then an SSP1 form should be issued, in this case ticking one of the boxes to confirm that SSP is no longer being paid due to contract ending.
    It is true that an employment should not be ended in order to avoid paying SSP but difficult to prove, no doubt they will have some other reason if queried.
    If the employer refuses to issues SSP1 then slaim and advise no SSP1 as refused.

    Its depression not pregnancy related. I have no contract.
    it was a 35 hour week contract for 6 months, i didnt get any notice from the agency just a trxt saying my employmemt has ended. As they have paid me a week ssp and they no longer can pay me i requested a ssp1 form so i can take the job centre, the agency said HR will not send this?

    Yes also struggling with debt etc which is all getting a little to much, unfortunately we have split no fault of my partners i just cannot burden him with my problems. Its only temporary. I also have my 1st counselling session Friday.

    Just a shock about work i really wanted to go back possibly next week.

    I have a text message where the agency are saying they will not send a ssp1 form out. also no reason why my contract ended. It was til September although i habr no proof as no contract was sent to me etc

    A couple of weeks ago you said you contract ended at the end of August. Which is it?

    I've worked as a contractor and as a temp. No ones gonna pay a contractor to be off for five weeks, it's just the way contract work is.
  • I wasnt sure what end of september it was beginning or end i was just being told september this was by the direct employer. But again no evidence. Either way they arent paying ssp which is fine, i need the ssp1 form which they wont give and im not sure why. HMRC helpline advised they have to issue this? I know as a temp worker i have no right but as i have been there over 12 weeks i know i was entitled to ssp wasnt sure who from work or government. As my contract was still ongoing i assumed worked, this now isnt the case, but as they have issued a ssp payment already i need the ssp1 form. I just cant seem to get them to send it me.
  • Also i didnt want 5 weeks off i have an appt next wednesday with the doctor, at the time i went dr advised she is signing me off and getting me help because i was a state. Will call HMRC and seek advice.

    You must have a contract - you've been working for them. Agencies issue paperwork, so you should have got copies of what you signed. The problem here is that it may be that you aren't an employee - in which case they are right and they don't issue SSP1 forms. Were your wages paid through an umbrella company? How did you get paid?
  • I was employed by a recuritment agency and got paod directly from them. I was classed as a temporary worker for my local council. I tiok copies of my ID into them which they photocopied. Never received paperwork. I wasnt workimg through an umbrella company. The agency paid my wages my holiday pay etc. I have been told i need them to send me the SSP1 form to say why they arent paying ssp. I cant just send my sicknote to the jobcentre as the agency have paid me for a week already. Very confused. Think i will go into the jobcentre tomorrow as HMRC kind of just said i need ssp1 and employer has to issue something about the 12 week rule.
