Short term time & SSP

Hi I was just wondering if anyone could help

I work full time with a short term time period of 2 weeks out of year, my salary is pro-rata accordingly.

The term time contract started on 1st April, however I've been off work sick since 27th March and I'm returning this week

My term time of 2 weeks was in June - my employer said I've lost this time and not entitled to the 2 weeks, but the Doctor said it doesn't seem right as she had provided me with a signed sickness absence so I should have been on SSP.

I'm not sure at all, and don't want to create any negativity when I go back so was looking for advice here if possible

    I'm sorry but I'm maybe being dense this morning - I can't understand what you are saying. You only work (and get paid) for two weeks? If you started the contract on 1st April and hadn't actually done any work for the employer, then they would be correct. To receive SSP you must have actually worked for the employer, and your period of sickness started on 27th March. To be honest, I think it would be questionable even if you had gone sick after 1st April, as you hadn't actually done any work for them. There is also a minimum income level of earning £113 per week - you couldn't have been earning that if you actually only work two weeks per term.

    That makes two of us. I often have to dig deep where there may be barriers to understanding however this one left me flummoxed.

    Oh good. It isn't just me then. I was struggling with a contract starting 1st April for term time, where someone only works two weeks in June, and it's going "back to work" next week when it isn't term time!

    I might be wrong here but I think OP may work a 50 week year with two unpaid weeks in June? However until they come back we will not know!

    Hi I'm sorry for the delay in getting back online

    I'm sorry I'm not clear, I work full time 40 hours a week in the civil service in a position I've had for 15 years. In addition to normal annual leave, public holidays etc, I also avail of 2 weeks of term time leave which I'm not paid for. My wages are worked out over 12 equal months.

    My question was that my Doctor signed me off sick and I receive SSP.

    For the 2 weeks in June that I was supposed to be off on term time (wages deducted accordingly for 12 months). My Doctor had provided a sick note inclusive of that time frame, I'm just not sure if I can have term time and SSP at the same time and my work isn't very clear

    Ah, right. In that case I think I agree with the employer. Your wage is normalised over the year, and you actually should get full pay for sick time because civil servants have occupational sick pay. So you don't get SSP also! You may not actually be paid at that time, but it is a regular occurrence - this is the contract you agreed to. By being off sick toy agent any worse off because this will still be sick leave and pay off your normal benefits of employment. To pay SSP in addition would put you better off being sick than if you weren't. Because you still get the annual salary. In full.
