    Your income is fully subject to UK tax. Doubtless the employer will have taken legal advice on their obligations under English/ Scottish law. I'd ask the employer to share that advice with you.
  • Hi all. Did anyone facing this issue find any clarity? I'm a UK citizen currently living in US. I am intending to relocate back home with my wife (US citizen) who will remain employed by her current US employer but will work from the UK. On this basis I believe HMRC IR35 regulations mean she will not be able to be considered an 'independent contractor' for the purposes of her taxes as she truly is a full-time employee of the US company. The issue arises because her US company doesn't have a nexus in the UK so will not be able to set up UK payroll for PAYE and employer NICs. 
    How has anyone navigated this scenario? It's sooooo hard to find information even though this clearly cannot be a rare circumstance these days. 
    I'm clear that she will be obligated to pay UK taxes as a UK tax-resident. She will also be required to submit a Federal tax return in the US - but will be able to avail of Foreign earned-income exclusions etc. It's just really hard to figure out how she can properly ensure compliance to UK tax obligations when her employer will be paying her effectively as a US-employee (who just happens to be working from the UK). 
    Appreciate any thoughts.
