    Lenders MAY be obliged to read them, but it does not mean they are obliged to do anything dfferent - otherwise everyone would just put a note on saying please ignore, its not mine and happy days.

    I feel like you are asking the wrong questions and getting the wrong answers and basing your next move on them...
    I have since asked santander and nationwide if additional documents can be submitted with application for them to review before making a decision, they have replied stating when applying online there is a form to upload all documents along with application for review and before any credit checks are done.
    That may be correct, but you have to first pass the credit check. That is not as simple as fitting criteria. I have a trainee broker who was under the impression that fitting criteria is an accept - thats not the case.

    It somehow feels like if you get the result you want, it will be luck rather than science. I dont mean to big up our job, but there is some skill to it.

  • ACG i believe i have a much better chance at fitting the criteria with a 40% LTV than passing the credit check because of the ccj.

    Are you able to converse with a lender that you deal with on a regular basis to explain a clients situation when submitting an application ?

    What I tend to do is to call account managers/underwriters and explain the adverse and then get an idea as to whether it is likely to pass or not.

    At that stage, lenders are not usually interested in the reason behind it because it will come down to passing the credit check. IF it passes the credit check then they may ask for a reason - but you have to fit criteria and pass the credit check first. Most of my account managers are pretty decent in that they will tell me if it fits criteria and based on their experience it is likely to pass or not.

    Banging your head against a wall doesn't help. It was a genuine question. There is no point being a !!!!! with people who are trying to help you.

    For all we know, you could have been the registered keeper with your brother driving and you decided to ignore the notices.

    The only details the scamming t*ats would have been able to obtain are the Registered Keeper details for the vehicle from DVLA.

    With nothing to the contrary, it's the RK who would have had the County Court claim issued against them.

    From reading around on the forums, i believe halifax, nationwide and natwest are the most amenable to adverse on file, but on the other hand santander seem a little more picky and hsbc very stringent, with your experience does that sound about right?

    Ha! you perceived my answer in a different light mate, i was banging my head against the wall as to why they marked it on my file, because of the similar name and we were living at the same property years ago, thats why i put the question mark ?
  • kingstreet, is it at all possible to have it set a side without paying court fee ?

    I have done some looking around and the ubiquity of erroneous marks against peoples files is astonishing, for something so little and easy for these lice to process has great impact on peoples lives, the system is a serious flaw! and it needs to change! people need to have more protection over their name / future as it's not only damaging them but also their young.

    For example, a default is between creditor and account holder so easier to manage. A court judgment requires intervention by the court, so whatever the fee to have it set aside is what it is. Is the set-aside the right process for mistaken identity?
