2016/17 overpaid tax - refund?

Is form R38 still the one to use? Previous employer issued p45 before final payslip so when it arrived it had emergency tax, therefore need to claim the refund.

  • If the P45 was handed into a new employer then emergency tax on the extra payment is more likely to result in you owing tax (unless on low income)?

    Have you calculated the tax position for the year as a whole?

    Don't know about R38 but gov.uk says HMRC are reviewing last years tax at the moment and people will hear by October about any tax owed back

    Just ring them, it can be sorted within minutes over the phone.

    Sorry, I wasn't overly clear. P45 was issued with correct code so tax to date on that was spot on, same company then made final payment of holiday pay and a bonus after the p45 date so that payslip showed the OT tax code, with full tax on whole amount. I worked out the tax due for the full year and the person has indeed paid too much due to the OT code. New employer in 17/18 tax year initially used incorrect code so deducted too much in April and May, however this was sorted in June with the overpayment refunded (not the 16/17 overpayment).

    Yes, subsequently read that. Would rather not wait up to 6 months as they do not pay interest on the money they hold so would rather it be in the account of the person who is due it than the bank account of the treasury!
