    Hi all
well i have just received a reply from one of my creditiors (Capquest). Their letter says "please find enclosed the document as requested" but all they have sent me is a copy of the original letter skycard sent me to inform that they had sold my debt to capquest.

i suspect their trying to bluff here and hope that i dont continue further, what do ya's think?

also is the cca the document that i signed when taking out the cred card ?

That is NOT a 'true copy of the original consumer credit agreement' - ALL it proves is that CRAPQUEST have purchased a piece of paper which 'claims' that you owe a certain sum of money. As a document it has absolutely no relevance to your legal request for a copy of the original cca, and is, therefore, worthless.
Providing that you sent CRAPQUEST the letter, as suggested by Weller, then CRAPQUEST have failed to provide you with a true copy of the original cca and, therefore, without a court order this agreement is now irrideemably unenforceable.
I would suggest that you pm Weller, as she has posted details of what a cca MUST contain - if I find the link I will post it.

    Good luck.

Exactly what did they send you?

Just because it has the words Consumer Credit Agreement, it does not mean that it is one.

Did you get the terms and conditions etc?

I requested a copy of my credit agreement from debenahms. i waited for 4 weeks, nothing. Rang them, they told what address they had sent it to and i've never lived there. it s amixture of my old address and new address.
surely this is a serious breach.

So upset that someone has access to all my information.

I've reported it to the ICO and wrote strong letters to Ge Money, but feel that they aren't taking my concerns seriously enough.

I want compensation for this, does anyone know if i am entitled to any.

I am not sure about 'compensation', br, but GE Money do appear to have acted in a most unprofessional manner.
Did the ICO suggest what further recourse you might have?

I care for someone hat is disabled, and he has been recieving leters from what looks like numerous companys, requesting payment for scottish power.

He is with someone else for his gas and electric and does not remember having an account with scottish power.

I have phoned on his behalf to Scotcall and requested copy bills an original agreement etc, but i was told that they do not have any copy bills etc due to them being 3rd party Debt Collectors.

Am i right in thinking that the same rule applys and that i can send the above letter to them ?

Thanks i advance for any info

    Angel

There seems to be two different bills, he has already had a door collector come and when he was asked to provide a copy bill, he posted a final notice card through through the door from scotcall, with just balance on etc.

He has not been back since and that was about 3 months ago !

    Hi

Unfortunately utility debts are not covered by the Consumer Credit Act, so a CCA request wil not work.

I would think a call to Scottish Power might be in order, plus a check of his credit record to see if there is anything on there.
