Stuck in a mortgage with my Ex

I was hoping someone might be able to advise me on the best way through this.

I am stuck in a mortgage with my ex-partner. We have been separated for 3 years and she now lives in the house with her husband with both of them responsible for all bills.

I myself am now married and want to buy a house with my wife but I am unable to get my name taken off the original mortgage because neither my ex, or her partner are currently working and are therefore seen as a risk to the lender.

It is unlikely that this will change in the near future so I am stuck in a mortgage that I don't contribute to, and for a house that I don't live in, in a town I don't live in. Is there any legal precedent that might enable me to get my name removed and move on with my life? Obviously, while I am tied into the mortgage I am unable to get a mortgage with my wife.

    You would have to force a sale. Not cheap and not 'quick' but that's the only way without her agreement.

    There is no legal precedent to make a mortgage company release you from a debt you signed up to, no.

    1. You could pay off the mortgage.
    2. You could sell the house.

    1 will cost a lot and you proibably can't afford it. 2. Will be expensive without your Ex's help and from the sound of it they will be resistant.

    The time to sort this out was when you split, leaving it has made it a bigger problem.

    Why didn't you resolve the issue of the property when you divorced?

    Is there much equity in the property?
  • I didn't want to force her out of her home. I was moving on anyway so it seemed like a fine solution.

    No, not really. A sale should see it break even

    We didn't divorce as we were never married. We separated and she wanted to stay in the house but at that time was unable to remortgage in her own name due to being on long-term sick.

    I didn't push to sell the house because I didn't want to add to that by forcing her out of her home so I left it as was. She could afford to pay the mortgage independently and this has only become an issue as I have been looking for a new place myself.

    Unfortunately none of that helps your situation. Your two options are listed by Carrot007.
