My dad died in November 2016. I had very little contact with him but was classed as his next of kin. He was a pub landlord and had considerable debt. I contacted everyone I found correspondence from to advise that he had died and that he had no money, no will no life insurance and no property. I sent copies of his death certificate and heard nothing from anyone apart from the above named solicitors. I sent them details of the few hundred pounds he had in the bank in the form of receipts and also receipts to show how the money had been used (travel to and from Scotland to Kent where he lived on two occasions - once to arrange the funeral, once for the funeral and family flowers). As he had no money the brewery paid for the actual funeral service. DrydensFairfax continue to harass me despite me contacting them and advising that I am not an executor only a next of kin. I advised them that he rented the pub from the brewery and he had no assets only debts. I have asked them to stop contacting me but now have received another letter from them asking me to sign something giving them permission to access his closed bank records. I am not prepared to send them anything with my signature on. Is there anything I can do to stop them harassing me. Any advice would be greatly appreciated.

Ignore them and block them from calling you.

    Any letters return to sender.

You are not liable for his debts, in any way, shape or form.

Thanks for that advice. They had sent me two authorisation slips to sign for them to access his bank and I was concerned about sending them anything with my signature.

Place them in the recycle bin. Don't sign anything.

(Since you weren't his executor your signature would be no more valid than mine as a means to access his bank account details anyway )
  • I too am having issues with Drydensfairfax who are a bloody nuisance.

They are trying to claim I owe their client money, when I know I don't.

They keep hassling me for payment, and cannot provide me with proof of debt.

They have also slapped a default on my credit file without sending me default notice and not being the debt purchaser.

This is not what you said in your previous (several) threads on this subject. It was an MBNA debt sold to Max Recovery that they are trying to recover, so explain why the debt isn't owed?
  • I am aware that Max Recovery purchased the debt for a lot less then the original balance.

I have no signed contract with Max Recovery.

Drydensfairfax don't owe the debt why put a default on my credit file!?

Debt purchasers inherit full rights and privileges of the original creditor, it matters not that you don't have a contract with them.

If you dispute the debt, send the provit letter.

    No. You do.
  • I have asked for evidence of the debt.

Sent me a copy of a credit agreement which I understand has now been terminated, even though I haven't received any official notice.

Hasn't sent me a copy of the deed or notice of assignment thats been asked for.

So have no proof Max Recovery legitimately owe the debt.

Again. They don't. YOU owe the debt.

    They don't owe you anything.
