Post Dateed

Just to let you all know that if you post date a cheque nowadays it can be cashed as normal once it has been presented (meaning if you are on a tight budget and wish cheque to be presented at a later date to save you going overdrawn it dont work anymore), BE AWARE.
YOU ALL MAY BE AWARE OF THIS ALREADY, I ONLY JUST FOUND OUT!
Luckily i'm rich and famous, didn't bovver me!

    You are not allowed to present post dated cheques anyway

    Apart from anything who the hell uses cheques these days:D
  • I sent one to a holiday company post dated and it worked ok for them.
    I phoned bank to query it and they told me thats how it works now, SO THERE!

    I used cheque as they charge £3 FOR USING PLASTIC.

    This has ALWAYS been the case and in fact its illegal to send a postdated cheque. The fact that you have and the company have honoured the date on it is down to their discression.

    It always used to be illegal to send a postdated cheque unless you had agreed this with the payee in advance.

    But for many years the banks haven't bothered to check the dates on cheques, so enforcing a postdated cheque has become pretty well impossible and the banks will normally process them immediately, whatever date is on them.
  • If you have the unfortunate crossing with a bailiff...they insist on post dated cheques for any amount owed after you have paid an initial payment....so is this illegal or not?

    I dont think its technically illegal to write the cheque out, the crime is of deception if you knowingly plan to present a cheque the funds dont exist for and use post dating to get round this

    So writing a cheque to a bailiff which you and they know wont be presented until a later date is probably acceptab;e

    If you post dated a cheque and then sent it off without telling them then there may be a crime element relating to deception

    It is completely against banks t and cs to do it but then unless your doing it all the time I doubt they would bother

    I dont think that anyone would really get proscecuted although the banks could get @rsey if they so wished to due to the breach of the t&c's.

    The main point is that a post dated cheque really has no meaning to the banks so if you provide the baliff with a shed load and he banks them you dont have a leg to stand on when they either clear your account or incur charges.

    Personally I would never agree to it (buts that probably because I dont trust anyone):grin:

    It says quite clearly in the front of my cheque book "remember, you should never write a future date" take a look at yours.
