Advice needed - Cleaners

We have a cleaning contractor who we have given 90 days notice with, they do have contracts with other companies. Just trying to understand where we stand, we have a new cleaning co coming on board in a couple of weeks.

Does the new cleaning contractor have to offer the current cleaner a position even though she is employed by another company?

    It's nothing to do with you. If TUPE applies it is between them. You just get cleaning done. So you should stand in the "it's none of our business" area and stay out of it.

    I think that if TUPE does apply - and I agree that's between the two cleaning companies - and the new company says they want to send the old cleaner, if you don't want that you'd better check your new contract allows you some choice over who is sent ...
