How to complain about a recruitment agency

I worked for a couple of weeks in March with a local recruitment agency in Glos and still haven't been paid, I've gone down the route of an official complaint but got no response. I have spoken to a nice lady at ACAS who gave me the link for a leaflet for the Employment Agency Standards Inspectorate Department for Business, Enterprise & Regulatory Reform which includes a telephone that doesn't exist any more. I googled them and got a new number which is just an automated voice that tells you to ring ACAS though there is an option to leave a voicemail which I have done.

Really I just want to know what my next step is, I mean will this company fight on my behalf to get the money I am owed (some £300) or do I/should I/can I just go down the route of an application to the small claims court where I shall be including compensation for having no money for 6 weeks and a refund for the bank charges they cost me.

  • I was with a recruitment agency in last position and it actually took 4 and half months to get holiday pay paid up after leaving the assignment, it's all the umbrella agg now with agencies as I understand it.

    Of course you can write a letter give so many days and then lodge a money claim online.

    You can go down small claims route. That is the cheapest and easiest option.


    However you probably aren't entitled to any compensation, you would be entitled to recover any unavoidable losses, but you need to show you took steps to mitigate this. E.G by contacting your bank to ask them to hold charges.

    what excuse are they giving you for not paying?
    I would start by sending a "Letter Before Action" and title it as such. Give them 14 days (or what ever time frame you think is suitable) to pay you what is owed before you take it to small claims/Money Claim.
    Provide proof that you are owed this - any timesheets, evidence that you went to the assignment, correspondence between you and the agency and or client.
    I would also check out their website to see if they are a member of any regulatory bodies, trade associations etc and write to those advising them of a member's poor treatment of workers. Also write to you local MP

    1: How do you find out who your MP is?
    2: What do MPs do and how can they be of any use to an individual?

    MPs are those government people who campaign for votes in various elections aren't they?
    Sometimes my advice may not be great, but I'm not perfect and I do try my best. Please take this into account.
