Employer refusing to send p45

Hello, my partner recently got laid off work. He received his final May pay with a payslip and is now in new employment. He then received a letter saying his pay was a admin error and he needs to pay back the money before they will send out his p45? I could pay a little back each month but fairly annoyed that there refusing to send out his p45. Any advice? :beer:

It's possible that if the previous company haven't produced one that HMRC will decide the OP's OH now has two jobs, and stuff up his tax code. But you're right that on starting a new job WITHOUT a P45 (which happens fairly regularly), you can get by without it by completing a New Starter Checklist.Dazed_and_confused wrote: »What do you need the P45 for?Signature removed for peace of mind0 -
As the P45 is supposed to show the amount of income received and the amount of tax paid, I don't see how the previous employer can issue a P45 until the issue of a potential overpayment has been resolved. If they issued on the basis of what the OPs partner has currently received, the figures will be wrong if the overpayment is recovered.0
