New to MSE and maybe be on wrong section but here goes anyway.
I have shared access with network rail. Our drive is shared with their gate at the bottom of the drive and then another set of gate for them to access their yard.
They want to remove the gate at the bottom of the drive which has been there for nearly 15 years. Does anyone know if they can do this. They now say it's a safety issue, but hasn't been for last 15 years.

You probably need legal advice. My question is if one set of gates are a safety issue then why are the others, for their yard, not a safety issue.

Depends who owns the land.

What convenients are on this land for access for you and them. Need to look at the deeds for your house or neighbours. You can get a look at thier deeds which you can do by the land registry for a few quid.

What about your safety when they remove gate. Eg. upped risk for burglary etc.

Another point. Are you sure it's Network Rail. They are wholly owned government company now. Railway operators are private companies. .

Could be the safety issue is in the fact thier lorries block the main road temporary as the guy in lorry has to get out the cab to open the gate.

But with it not there he could just drive straight into the drive and the only have to get out of the cab at thier site to open gate or someone on thier site will automatically let them in.
