Can I move one DMP debt to reduce interest charges?

So you've still heard nothing after a month ?
Letter above is good to go, yes.
I would be quite interested in the outcome of this, as charging interest on a "sold" credit card debt is just not allowed, unless it has not defaulted, let us know the outcome please.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Thanks sourcrates, I was waiting until you were online!
Yes, they're still charging interest, so I'm going to play hardball. I'm just so annoyed, our other CC debt is reducing nicely but this one is just dragging on and on.
Letter will go out tonight and obviously, I'll keep you posted.
Thanks again!"I may be many things but not being indiscreet isn't one of them"0 -
(a not very exciting)...***UPDATE***
Two letters from RW this week. One is a standard letter stating that they have not yet received a response from the original creditor (Marbles)
The other is a grammatically-dubious letter from a RW twonk who states that they will "Ensure to respond to you as soon as possible"
when they finally track down the CCA that I requested.
No mention of interest charges but they have suspended collection activity on the account.
I don't want them to suspend it, I just want them to stop charging exhorbitant amounts of interest on the repayments!
If they've suspended the account, I'm wondering if there's a chance that they may not have access to the CCA? Which will be good news for me, I guess? They're going to get a very low F&F offer if that is the case. Fingers crossed!"I may be many things but not being indiscreet isn't one of them"0 -
Ok, two possible outcomes here.
(1) they produce the CCA.
(2) or they fail to produce CCA.
No CCA means you could just walk away and cut your losses.
If they do produce it, then the charging of interest becomes a separate matter, which you should pursue all the way to the ombudsman if necessary.
Either way, you have a route to pursue.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Yes, it looks that way. And I'll definitely be pursuing the interest issue, they're just being greedy, if not downright dishonest.
Of course, if they had actually bothered to read my letters properly and stopped the interest, they would still be getting payments, I wouldn't have bothered asking for the CCA and everyone would have been happy.
I'm just hoping and praying that Marbles had a big old clear out and got rid of the paperwork!"I may be many things but not being indiscreet isn't one of them"0 -
I'm still paying to RW via our DMP and, having looked through all of the paperwork, I've a sneaking suspicion that they never defaulted us on this debt (a Marbles CC)
We also had 2 other debts and I have default letters from both of them. Having checked Noddle, they have been applying AP markers, so it looks like it has never officially defaulted, despite us paying token £1 payments for two months, then a reduced sum ever since. This was all back in 2010, so any default would have dropped off by now, as they have done for the other debts.
I have a letter from RW which they sent after buying the debt, and which states:
"The total balance sold was £2064.01. Any payments made towards
your account after 29/7/16 will be deducted from the balance shown above"
As there's no mention of interest charges, surely they cannot keep charging interest?
There's still no sign of a CCA, and we're thinking of stopping paying now, they've had long enough to find the paperwork (request was sent in June!), but we don't want to be suddenly defaulted on this, after 7 years of paying. I've checked our DMP statement this morning and the original debt amount has been all but paid off, but the interest charges mean it's just dragging on and on.
I just don't know what to do for the best?"I may be many things but not being indiscreet isn't one of them"0
