Hi! Just a quick update!
Contacted Lowells and they have put the account on hold and told me they also have the Ikano debt as well (again Ive not been informed of this) so I told them the same thing is happening with that and they've put the account on hold.
I have only had one reply re the letters I sent and that is from Barclaycard who phoned me today to say they were totally at fault and had charged reduced interest when they shouldn't have - so are sending me a cheque for the amount they had pass to the debt collectors plus £100.00 to say sorry. Interesting comment by them that they will send a letter confirming and including details of the Ombudsman but they assume I won't take it further. That rings bells in my head because it make me think they must be REALLY at fault and are worried I will complain to the Ombudsman! They said they are going to contact the credit reference agencies to tell them its now settled
They said I need to contact the debt collectors to agree a figure to pay....is this correct or should the debt now be written off?

That is confusing.
Have they actually sold the debt to Link?
So what they are saying is that they will mark their entry on your credit files as settled (which is what they should have done when they sold it).
Is the value of the cheque they are sending you below or above the figure Link are quoting?0 -
They said they have sold the debt to Access - I had Link as the debt collectors from the information on Payplan as I haven't been contacted regarding the debt by any agency but Barclaycard are going to send the contact info in the letter they are sending.
Yes they said they would do that....I will check my credit report and see whats on there
I've just checked the balance that Payplan have and its £200 more than what Barclaycard are going to pay me - but I have no idea where Payplan are getting the balance from (Im guessing the debt collection place?)
I told them to put in the letter exactly what they were paying me for interest and charges so once I get that if the debt agency are asking for even more I will go to the Ombudsman and it seems that Barclaycard will need to prove the amount they have sold on to the debt people - is that correct?0 -
Bit of an update: Received the cheque from Barclaycard which is £980.00 the debt they have passed on to Link is £1228....I have just phoned Barclaycard and they have no valid explanation why instead of £53.00s worth of debt being outstanding £1283 is and yet they have supposedly paid back all interest and charges with equals £980! Leaving an difference of £250!
All she has said to do is for me to request a subject access request for statements prior to May 2004 which is all they can go back to!
Any suggestions???? I don't really want to be paying out £10 for statements which wont actually be of help really (and surely they should be looking at them seeing as the DMP started in 2003) but I always dont want to pay £250 when I have no idea what it is for.
She has told me to contact the debt collectors they passed it on to and sort it out with them - surely this isn't correct considering I've never been informed that the debt has been passed on.....
Can I complain further to the Ombudsman about this to reclaim the extra £250 - I can get screen shots of what the original debt was and how much I have paid from Payplan...is it worth sending everything to the FO and complaining further?
And haven't heard an thing for the rest of my creditors!!!0 -
Yes take it to the FOS, they will instruct BC to sort matters out correctly.
If BC are unable to access statements from that period, they may write off the balance as a gesture of goodwill.
But you must take it to the FOS.

Thank you! I will do. I really couldn't get the woman to understand that they had sort paid by £300.00. Im also not happy that they phoned at work and said I had to talk to them on that day as they had four days to turn around complaints and that was the last day so they had to get it sorted! I had none of the figures with me or anything!!
I came home to a group of letters:
Ikano - they have replied to the letter by sending me a letter telling me the debt is now with Lowells! I can't believe they have ignored the request for the CCA and statements and ignored the letter stating I have a complaint! Im thinking take this straight to the FO?
MBNA - they say they cant verify the account from the account numbers I have given them (even though they have passed these same account numbers to Idem to collect the debt!) and want me to call to verify every address I have lived at, account numbers, etc, etc - am not sure whether to call them or not. They definitely know about the accounts as they are currently working out my PPI after having been told off by the FO and charged 8% interest for refusing to refund!!!
Co-op - they have said they don't have paperwork as its over six years old. However, Payplan have told me that the debt is with Cabot (and still £200 to pay) - but I wrote to Cabot requesting a CCA and they replied in October saying it couldnt be located and they wouldnt be chasing the debt. I have checked my credit report and its not showing on there so does that mean the £200 isnt going to come back and bite me at some point? If the debt is gone Im more than happy to let that one go!
Oh and forgot to add I contacted Payplan and asked them to give me opening balances,. amounts paid and any information they can but they haven't replied. Im really annoyed by the way they have treated me as they would have happily had me paying more and more money to debts that don't exist anymore or those which should have been cleared. Is there anything I can do about them?0 -
