FULL TERMS AND CONDITIONS

1. This Promotion is open to residents of the United Kingdom aged 18 or over, excluding employees of the Promoter, their immediate families (spouse, parent, child, sibling, grandparent and/or "step") and those living in the same households for at least three months during the twelve-month period preceding the start date of the Promotion, agents/agencies or anyone else professionally connected with this Promotion.

2. Those who are banned from attending any sports event or on an official list of known football “hooligans” are not allowed to enter this Promotion. Similarly, a winner cannot select as a guest anyone who is subject to a football banning order, banned from any sports events or on an official list of known football “hooligans”.

3. Promotion Period: Enter between 00.01 BST on 22 May 2017 and 23.59 BST on 28th May 2017.

ii. Publicly comment under the promotional post with your picture or video taken.

iii. Add the hashtag #GetThereWithGinola to be entered into the Competition.

or:

i. Log on to your Facebook account (or create one for free at https://www.facebook.com) and follow @NissanUK.

ii. Publicly post your picture or video taken on the NissanUK page.

iii. Add the hashtag #GetThereWithGinola to be entered into the Competition.

d. Email: Send an email to GetThereWithGinola@fuseint.com containing your picture or video taken to be entered into the Competition.

6. Facebook, Twitter and Instagram entries that do not contain the hashtag will not be valid.

8. By submitting your information and creating a Facebook, Twitter or Instagram account, you agree to the Facebook, Twitter or Instagram terms of use and privacy notice. If you do not agree to such terms of use and privacy notice, you cannot create a Facebook, Twitter or Instagram account, or participate in this Competition.

9. Entrants must continue to follow @NissanUK after the end of the Promotion Period in order to be contacted if selected as a winner.

10. Multiple entries are permitted during the Promotion Period.

11. It is the responsibility of the entrant to ensure their Facebook, Twitter and/or Instagram account is set to ‘Public’ in order to allow relevant details to be extracted for entry in to the Promotion. The Promoter is not responsible for any failure to extract details from accounts which haven’t been set up as required.

12. All entries must be received by the end of the Promotion Period to be valid and no liability is accepted for illegible, incomplete or late entries.

13. The Prize: One winner will win 1x pair of tickets to the UEFA Champions League Final in Cardiff on 3rd June 2017.

14. Additional Prize details and conditions – UEFA Champions League Final 2017 Tickets

a. The Prize includes:

i. 2x Hospitality tickets to the UEFA Champions League Final at the National Stadium of Wales at which they will sit next to David Ginola. This includes food & drink within the Nissan hospitality areas;

ii. travel to Cardiff, Wales -. This travel includes return travel to the event destination and stadium transfers once in Cardiff, Wales. All other travel within Cardiff during the winner’s stay is their own responsibility;

iii. two nights’ accommodation on the Magellan Cruise ship, docked in Newport, with Friday evening meal, breakfast on Saturday and Sunday and Saturday lunch; and

iv. UEFA Champions League merchandise.

b. The winner may be required to provide proof of age and identity and any documentation as reasonably required by the Promoter to validate their eligibility to claim the Prize;
c. The winner will be expected to comply with any third-party terms and conditions that form part of the Prize, including but not limited to UEFA Champions League Tickets Standard Terms and Conditions, and the rules and regulations of the relevant football stadium;
d. The winner will be solely responsible for ensuring that they have appropriate documents to ensure cross border access where necessary. A valid passport will be needed to board the Magellan Cruise ship.
e. Travel insurance is the responsibility of the winner and their guest;
f. The winner’s guest must be aged 18 or over;

g. The winner and their guest must travel together in both directions;

h. The winner is solely responsible for any additional charges incurred at the Magellan Cruise ship during their stay, including, without limitation, costs of additional meals, drinks, additional nights and services;

i. A valid credit or debit card may be required to check in to the room and will be used to guarantee any incidentals such as in-room calls or services;

j. All elements of the prize package must be taken as part of the same trip;

k. For the avoidance of doubt, the Prize does not include additional food or beverages, souvenirs, gratuities, car parking charges, additional excursions and attractions or any other costs of a personal nature that are not explicitly set out in these terms and conditions (including spending money) and neither the Promoter nor any provider of any part of the Prize will be responsible for any such costs;
l. The winner is responsible for the behaviour of themselves and their guest whilst enjoying the Prize. The Promoter reserves the right in its absolute discretion to exclude the winner and/or guest from participation in the Prize if the Winner and/or their guest fail to comply with the directions of the Promoter or any companies associated with the Prize or the Winner and/or guest act in a manner that is dangerous to themselves or to the public or is anti-social in any manner or which causes a disturbance or nuisance to others;

m. The winner must inform the Promoter of any wheelchair or any similar access needs for either them or their guest; and;

n. The winner will receive their guest pack containing their tickets and hospitality passes at check-in onto the Magellan Cruise ship. These will need to be kept safe as these will not be replaced if lost.

15. It is the winner’s responsibility to provide correct details and the Promoter shall not be responsible for claims/prizes that are lost due to the provision of incorrect or incomplete details.

16. Prizes are not transferable or exchangeable unless otherwise stated and cannot be redeemed for cash or any other form of compensation. In the event for any reason a winner chooses not to take any element of the Prize at the time stipulated by the Promoter, then that element of the Prize will be forfeited and there will be no cash or other alternative offers, unless otherwise agreed. If due to unforeseen circumstances the Prize is not available, the Promoter reserves the right to substitute another Prize, at its sole discretion, of equal or higher value.

17. Winner selection: All valid entries received (subject to moderation) during the Promotion Period, from all entry routes, will be judged by independent judge, PromoVeritas, within 24 hours of the end of the Promotion Period and in accordance with the following criteria:

· Originality

· Scale of Ambition

· Creativity

Entries will be judged against the above criteria, each scored out of 10 (giving a total out of 30). The highest scoring individual entry wins. If there is a tie where 2 or more entries receive the same score the entry with the most shares on social media would be the winner.

18. Winner Notification: The winner will be contacted via a direct message on Twitter or Instagram, via a message under their original entry on Facebook or via an email (depending on the method of entry) within 24 hours of judging. The winner will be required to respond to confirm eligibility plus acceptance of the Prize within 48 hours of initial contact. In the event that a winner does not respond to communications within 48 hours of initial contact, the Promoter reserves the right to disqualify that winner and the prize will be allocated to an alternate entrant selected in the same manner who will have 24 hours to respond.



General

IMAGE ENTRY REQUIREMENTS

19. The entrant agrees to and understands that entries will be made available to the public, including without limitation, posting on the internet. Whether or not entries are published on the internet, the Promoter does not covenant or guarantee any confidentiality with respect to any images.

20. Each entry must be an original creation of the submitting entrant which is under no restriction, of whatsoever nature, that will prevent the Promoter’s use of the image. Each entry must be free of any and all liens, encumbrances and claims of third parties. The entrant acknowledges, agrees and warrants that nothing in the image infringes on any copyrights, confidential information, trade secrets or trademarks belonging to any person or entity other than the entrant unless with a suitable license, clearance or permission agreement (proof of which is required upon submission). The entrant also agrees that nothing in the entry violates any person’s rights of privacy or publicity and that all necessary permissions have been secured including releases from all persons appearing in the entry. The entrant agrees to indemnify and hold harmless Promoter and its officers, directors, employees, and affiliated organisations, and their respective officers, directors, shareholders and employees, from and against any and all claims, demands, damages, costs, liabilities and causes of action of whatsoever nature that are based upon or arise out of any breach by the entrant of these terms and conditions or the warranties and representations made by the entrant in this entry. Modifying, enhancing or altering a third party’s pre-existing work does not qualify as the original creation of the entrant.

21. By submitting the entry, the entrant agrees, in consideration for entry into the promotion, to grant to the Promoter all intellectual property rights in the image or video and each of its constituent parts, which rights include, without limitation, the right to edit, publish, make available to the public and/or reproduce the image through any media available at any time during, or after, the promotion period on any related websites, in any promotional materials, whether related or unrelated to the Promotion, and at any other location, whether physical or online, that the Promoter, in its sole discretion, deems appropriate and necessary for the operation and promotion of this Promotion. In addition, the entrant warrants that any so called “moral rights” in the entry have been waived and the entrant acknowledges and agrees that the Promoter may use any ideas from any entry or other submitted materials, whether or not the entrant has been awarded a Prize in connection with any such entry or other materials.

22. The entrant is responsible for securing necessary permissions, talent and location releases, and licenses for any visual material contained in the entry.

23. The Promoter is not responsible for any expenses incurred in the production and delivery of the entry.

IMAGE CONTENT RESTRICTIONS

24. Moderation: Entries will be rejected/deleted and will not be deemed valid entries for the purposes of this Promotion if in the opinion of the Promoter, they:

a. contain any content that is offensive or could reflect negatively on the name, reputation, or goodwill of the Promoter or any brand partner, including but not limited to David Ginola and UEFA;

b. include trademarks, logos, or copyrighted material not owned by you or used without the right holder's prior written permission (including famous names, company names, etc.);

c. defame, misrepresent, or insult other people or companies, including, but not limited to the Promoter (including its partners, including but not limited to David Ginola and UEFA);

d. promote any political agenda;

e. contain or depicts someone smoking or intoxicated;

f. violate or infringe another’s rights, including without limitation, privacy or intellectual property rights (including but not limited to copyright infringement);

g. contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

h. contain any unacceptable clothing or adornments, or display any commercial/corporate advertising other than that of the Promoter (including but not limited to corporate logos, brand names, trademarks, slogans, political, personal and religious statements);

i. contain indecent or unsafe behaviour or situations, profanities or obscenities, including but not limited to nudity, or pornography, or are otherwise inappropriate, indecent, immoral, profane, obscene, hateful, tortuous, slanderous or libelous;

j. condone or encourage violent or anti-social behaviour;

k. reference persons or organisations without their written permission;

l. disparage any persons or organisations;

m. include threats to any person, place, business or group;

n. are unlawful, in violation of or contrary to any applicable laws and/ or regulations;

o. represent a danger to health and safety or causes fear or distress; or

p. are otherwise offensive or in bad taste.

25. Failure of any entry to comply with the above “Image Entry Requirements”, “Image Entry Content Restrictions,” or these Terms and Conditions as determined by the Promoter, in its sole discretion, may result in disqualification of the entrant without notice. Without limitation, the Promoter reserves the right in its sole discretion to disqualify any entry if the Promoter receives notification about any potential infringements or breaches of law or any other reason set forth herein. Entries must be suitable for presentation in a public forum, in sole determination of the Promoter

26. The Promoter, Facebook, Instagram, Twitter and any and all Internet server(s) and access provider(s), and each of their respective affiliates, subsidiaries, parent corporations, advertising and promotion agencies, and all of their officers, directors, shareholders, employees and agents (collectively, “Releases”) are not responsible for:

a. any incorrect or inaccurate entry information;

b. human error;

c. technical malfunctions;

d. failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers, or software, including without limitation any injury or damage to a participant’s or any other person’s computer relating to or resulting from participation in the promotion;

e. inability to access or post the image or video to Facebook, Instagram, Twitter or via email;

f. theft, tampering, destruction, or unauthorized access to, or alteration of entries; or

g. data that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site (including Facebook, Instagram or Twitter) or for any other reason whatsoever; typographical, printing or any other errors.

27. Proof of posting to Facebook, Instagram or Twitter is not considered proof of delivery or receipt. Illegible and incomplete entries and mechanically reproduced entries will be disqualified. Entries will not be acknowledged. False, fraudulent or deceptive entries or acts shall render the entrant ineligible.

28. Entrants must enter the Promotion using their legal name. The Promoter reserves the right to disqualify any entrant who uses multiple names and to require them to return any Prize they may have won. The Promoter will verify the eligibility of entrants. The Promoter will require such information as it considers reasonably necessary for this purpose and a Prize may be withheld unless and until the Promoter is satisfied with the verification.

29. All entries must be made by the entrant themselves. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries, entries by macros or other automated means (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that entrant’s entries into the Promotion in a way that is not consistent with the spirit of the Promotion, that entrant’s entries will be disqualified and any prize award will be void. A Prize allocated to a winner who is subsequently disqualified will not be reallocated.

30. Where a winner has been found to be in breach of any of these terms and conditions and in particular where a person is in breach of the entry restrictions, the Promoter may nevertheless still enforce its right to disqualify that person and require the return or reimbursement to the Promoter of any Prize even where a prize has been awarded and/or actually provided to the entrant or Prize winner in question.

31. The winner is prohibited from reselling any tickets won or reselling any other element of their Prize.

32. Obtaining time off work and/or study or related activities to participate in the Promotion and/or take the Prize will be the sole and absolute responsibility of each entrant.

33. It is the responsibility of the winner and any guest to check any travel advisories issued by a Government, to determine whether they wish to accept the risk of travelling to the destination. The Promoter will not be responsible for any loss or damage suffered by the winner or their guest arising out of their failure to follow any travel advisories issued by a Government. The winner and their guest must comply with and are responsible for obtaining any inoculation and health regulations required by any Prize destination country.

34. The Promoter will not be liable or responsible for any loss or damage suffered by any winner or their guest should any winner or their guest not redeem a prize as a result of any Government travel warning or advisory applicable to the destination country and/or countries or for any other failure on their part to travel. In particular, the Promoter shall have no obligation to substitute any alternative Prize, cash equivalent or other compensation where a winner and/or their guest fail to redeem a Prize for any reason.

35. The Promoter makes no representation or warranty in relation to the Prize provided. Except as specifically set out herein and to the maximum extent permitted by law, all conditions, warranties and representations expressed or implied by law are hereby excluded. To the fullest extent permitted by law, the Promoter hereby excludes and shall not have any liability to any entrant or prize winner in connection with or arising out of this promotion howsoever caused, including for any costs, expenses, forfeited prizes, damages and other liabilities, provided that nothing herein shall operate so as to limit or exclude our liability for personal injury or death caused by our negligence or liability for fraudulent misrepresentation. For the avoidance of doubt, this paragraph shall also apply in respect of any prize provided by a third-party provider.

36. If for any reason the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Promotion.

37. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.

38. The winner acknowledges that once the Prize has been issued to the winner, the Promoter is not liable or responsible if all or any part of the Prize (including but not limited to the UEFA Champions League Final match) is cancelled, varied, postponed or rescheduled for any reason at any time. The Promoter shall be under no obligation to provide an alternative prize in such circumstances or to reimburse any incurred expenses by the winner or their guest as a result of winning or accepting the Prize.

39. The winner may be requested to participate in reasonable publicity arising from the Promotion with no further compensation.

40. Any personal data relating to participants will be used solely for the purposes of this promotion by the Promoter and/or by any agent appointed by it to assist with running the promotion on behalf of the Promoter and will not be disclosed to a third party for any other purpose without the individual’s prior consent. By entering this promotion, you consent to the use of your personal data by the Promoter and/or any agent appointed by it to assist with running the promotion for the purposes of administration of the promotion (including publishing your full name and county and/or disclosing it to third parties on request if you are a winner) and any other purposes to which you have consented. 44. This Promotion is governed by English Law and participants submit to the exclusive jurisdiction of the English courts.
