Tax and P60 help

in Cutting tax
Hi there
I left my previous job the first week of May this year and started new job last week.
Last week I noticed tax credits had gone down £400 per month. Phoned them and they said it is because I earned £20,500 last year. I told them I had earned about £10,500 max. They put me through to tax office who advised my ex-employer had submitted information stating I earned £20,500 last year. They said my ex-employer should contact tax office to rectify.
I emailed employer - its a small firm and outsource to accountants. After some chasing they replied saying accountant said the information they submitted to tax office was correct it how they captured this data which has caused the problem and they are looking into it.
I emailed again on Friday chasing. I phoned tax credits who were really good they said if I gave figure on P60 it would be rectified. I text an ex-colleague who said she received P60 some weeks ago now!
So.... my salary information submitted was either wrong when it was not submitted to tax office (or it is tax office's error), I have not received my P60 and I have not received wage slips for March and April either. I am also financially worse off through no fault of my own. Lots of time spent on this and phone calls.
I have emailed one of the directors today asking them to rectify the above and deal with asap.
If I do not hear anything or they don't rectify this week what can I do? Who do I complain to?
Thanks in advance.

Do you have an on line tax account - if so what does it show ? Surely with RTI HMRC should be able to see exactly what you earned.0

Thanks. I have tried logging on several times this past week but the are "experiencing technical difficulties". In any event the tax office say they have got £20500 down as my salary last year when spoke to them so assume the figure online will be the same. However employers are still to provide P60's and get them right.0 -
The final date for an employer to provide a P60 is 31st May so they may not actually have completed it yet. There also used to be a lot of end of year errors with RTI but that may be sorted now.0

Thanks for both replies. One of my ex-colleagues who works there got hers a few weeks ago so would have thought would get mine same time. I will see if I hear anything later this week or ring tax office to see if rectified. Its just in meantime I am out of pocket via tax credits.0

It's probably worth persevering with trying to access your personal tax account as this could well show information which would be useful when speaking to your employer. If you can see what they sent to the tax office through RTI it might be a step in the right direction.0

You have salary chits for end April 2016 through to end February 2017 and a P45 showing your earnings for end April 2017?0

The way HMRC get P60 information now is much different than in the past.
They dont actually get a P14 (the carbon copy of the P60) as they used to.
Each time you are paid HMRC get the details on a system called RTI, Real Time Information.
The employer submits payslips each payday upto week 52/ month 12, this is known as a Full Payment Submission (FPS). Your employer then has 2 weeks to submit any adjustments.
They then submit a final submission called Employers Payment Summary (EPS) if they failed to select 'Yes' to identify the m12/w52 rti submission as the final submission of the year, or if they didnt pay any of their staff in the final pay period or more. Again this should be within 2 weeks of the last day of the tax year.
What I've seen some employers do is submit a further m12/w52 RTI FPS submission with the full years details on it just to select 'Yes' to the Final submission option rather than simply sending an EPS confirming that all details are complete.
This can in some cases have the effect of submitting additional amounts to your income which you have not earned.
If the details are wrong then what your ex-employer will need to do now is to send an Earlier Years Update showing the adjustment, I.e if you earned £10k but the employer has shown £20k in submissions, they will now need to send an EYU showing -£10k and -£tax incorrectly shown deducted.
If your ex employer continues to deny having shown the wrong figures then call HMRC again. They have a stock letter they can send your ex-employer which provides details of what they have submitted and what they need to do to adjust it.
As you were working for them at 5 April 2017 they must send you a P60 by 31 May 2017, or if they are eP60's (as many now are) provide you access to their online portal, email it to you, or send you a hard copy by the same date.
They could face penalties if they fail to abide by PAYE regulations.[SIZE=-1]To equate judgement and wisdom with occupation is at best . . . insulting.
