Claim form from county court

Hello all,

I have just got a claim letter from the county court asking me to respond, acknowledge etc.

My question is that I am currently in the process of setting up an IVA at present, in which I have listed the claimant on. I only started this the other day and it's only just about to start being put in motion.

How should I actually reply to this claim? I'm a little confused, I can't pay it, but have made efforts to set something up to start repaying.

Many thanks,
David

    Hi david756

It’s very important to reply to the county court claim otherwise a CCJ will be made anyway, most likely it would be a forthwith judgment asking you to pay the full balance in one go. Once a CCJ is in default enforcement action can be taken.

To avoid this you will need to respond within 14 days of the date of service (you will find this on your paperwork). You now need to speak to your IVA company about the court claim and the offer of payment you will be making. If the IVA goes ahead the CCJ will still be included as long as it has not been secured on your property, should you own one.

You can find further information on how to respond to a court claim here https://www.nationaldebtline.org/EW/factsheets/Pages/replyingtoacountycourtclaim/replyingtoaccj.aspx.
