Can Anyone Add Debt To My Mortage Without Permission

Hi.

I am having to pay £745 in late payment ground rent "fines" because I paid £500 and not £550. A shortfall of £50. That is another story however.

This has happened before because I live in Guernsey and the ground rent dept won't send correspondence/invoices to an address in Guernsey. This is also another story.

When this happened before, the ground rent "fines" were added to my mortgage. I never gave permission to do so. I was disputing them. Are they allowed to add a debt onto my mortgage without me signing anything?

So far, I have paid almost £3000 in late payment fees.

Absolute theft. Disgraceful.

    Yes, they are.

    Default would result in the lender's security being compromised as the freeholder can take possession if you breach the terms of the lease; so it has to take any necessary action to prevent that and to protect your interests too.

    A UK accommodation address might be useful?

    Have you looked at something like this - https://www.scanmypost.co.uk/

    Letters posted to them are scanned and emailed over to you. I have no idea if this is a reputable company or not. I think companies like Regus also offer a similar service, but I could be wrong.

    Also, do you need to wait for an invoice before paying the ground rent? You should know how much is due, when and to whom.

    They said the rent was going up and to contact them in February regards to the rise. I had one invoice sent to me by my tenant but the other tenant did not send the invoice on.

    I had no other correspondence apart from the "fines".

    The refuse to send a copy to Guernsey or to send an email with the invoice on.

    Guernsey is not part of the UK. Legally the demand has to be sent to a UK address. In the absence of another UK address. The demand will be sent to the property address. Issue is yours to resolve.

    Why can't you just set up a Royal Mail redirection or can you not do that to Guernsey? They did not add a debt to your mortgage, they put a charge on your property which means you cannot sell it until their debt is paid.
