Can you claim stamp duty refund if your name comes off the mortgage/deeds?

Hi, I see you can claim a refund if your main residence is sold within 3 years. My girlfriend currently part owns a property in London but doesnt live in it.
Her sister is the other owner and lives there. My girlfriend is going to be off the deeds and mortgage this time next year. If we purchase a house now at higher stamp duty, can we claim that back when my girlfriend is off the other mortgage/deeds?
I know you can if you 'sell' your main residence within 3 years. Does this count as a 'sell' in mortgage speak?
tHanks as always,
Conor

Pretty sure it just needs to be a 'disposal' not necessarily a sale, but it doesn't matter as it hasn't been her 'main residence' to begin with as she doesn't live there, therefore no refund. (Unless it was her main residence at some point within the three years leading up to your current purchase)2018 wins: Aspinal of London jewellery box, Boudavida gym outfit, HP Pavilion laptop, The List party tickets, All Points East festival tickets, Kiehls moisturiser, By Terry cc serum, Nars Liquid Bronzer, Benefit highlighter, Nars illuminator, Fresh advanced lip trio set, Cetaphil sample set, signed copy of My Absolute Darling by Gabriel Tallent0

Will it still be higher stamp duty then if it isnt her main residence? It was her main residence until October...Just within 3 years!0 -
You will need to check if the main residence and disposal have to be at the same time with the time allowed.
Does she have any beneficial interest in the property?0 -
