Hello, sorry for jumping on this thread. Im not sure how to start a new one. I am in desperate need of help. I had a visit from the bailiffs with an attachment of earnings from the County Court with form N61. This is for an old debt which is statue barred. I haven't paid or acknowledged the debt since Nov 2010. I have got until Wednesday to complete the forms and send back to the court. Please advise im worried sick. Thanks in advance

You've got a ccj on it so it's not statute barred. If you did not defend the claim, and think you have a defence then you need to apply for set-aside

In relation to the N61, you must complete and return it as there is 14-day committal as a possible punishment for failing to comply.

Hi,
As judgement has already been made, all you can do now is to apply to the court to "set aside" the judgement on the basis the debt was statute barred, did you not receive court papers about this ?
The fee for set aside is £255.00, although remission is available if you are on a low wage or not working.

Thanks for the advise. No I never received court papers. I received the n61 on 8th may and it states I have 8days to reply. I contacted step change yesterday and they kindly emailed a N25 form which didn't seem the correct form and a stayed barred letter to send to the Court.0

I've downloaded the N25 form and also have a code to help with fees for this from the Government website.0

I'm not familiar with an N25
To set aside a ccj you need an N244. Your skeleton defence goes on the form.
I would still recommend replying to the N610 -
I've downloaded N244 form. Thanks for your help ☺0
