Unsecured Loan

My Mum has recently died and I am the executor of her estate.

She had a loan which was unsecured, I have been told that they would not be able to apply to the court for payment of this loan from her estate as it was unsecured.....Is this correct??

    You have been mis-informed, in general debts of the deceased are paid from the decease's estate.

    There is no need to make loan payments for now. If your mothers estate has sufficient funds to repay the loan, after modest funeral expenses, then this would have to be done before any left over is distributed to next of kin or anyone else in her Will.

    As executor you are responsible for this but a solicitor or citizens advice should be able to help you if you get stuck.
