Myparkingcharge.co.uk...Am I at fault? Do I pay?

I recently visited Iceland and parked in their car park which is operated by excel parking services. As I pulled in there was a van next to the only empty bay I wanted to park in with 1 parking inspector in the drivers seat and the other inspector standing by the drivers window, in the actual bay I wanted to park in. I got out and paid for my ticket via the ticket machine and I can only imagine they saw me doing as it was basically in front of where our vehicles were parked. I then placed my ticket on the dash board and walked off into icelands. When I returned to my vehicle I noticed a 'attention' notice on my vehicle. I got in my vehicle confused as I no I brought a valid ticket. I went straight onto myparkingcharge.co.ul and looked at the reasons for them issuing me with a fine and I noticed that because they fail to put a sticky back on their tickets, as I closed the door the wind must have blown the ticket over and the ticket was upside down. I have appealed this stating i had a valid ticket (which I still have) and when they finally wrote to me they said that my appeal was rejected as I hadn't properly displayed my ticket. They also said that as a goodwill gesture they will take £20 off the price. Should I pay this? Am I liable to pay? What would happen if I just ignore it and refuse to pay? Can I take it further to appeal again? Can I request they check there cameras and see that I brought a valid ticket? Any help or advice would be appreciated. Thanks.

First and foremost when you appealed did you reveal who the driver was? And remove reference to who was driving in the above post - replace with "the Driver".
You can post your appeal here - just remove any personally identifiable data from it (e.g. registration numbers, PCN number, name, address etc.).
Then once you have done the above read the "Newbies" sticky thread if you haven't done so already.
More advice will come along shortly and after you provide a little more information.0 -
It's all part of a recent sham that sees this warning notice of a possible breach of parking conditions placed on vehicles. Ordinarily you would get a windscreen ticket, there would be 28 days to pay, then if no payment the RK would receive a NtK after Excel had accessed details from the DVLA.
This new wheeze allows Excel to access RK details within 14 days. Why DVLA allows it is a mystery, but they bend over backwards to release your (and my) details at the drop of [STRIKE]a hat[/STRIKE] £2.50 to the PPC network. Expect that NtK any day soon.
What exactly are they offering you, payment-wise? A £20 'penalty' as a 'goodwill gesture', or a £20 reduction (from what amount?)?
Go to Iceland and complain vociferously that as one of their customers who clearly paid to park to shop with them (take a copy of the ticket given by the machine) that you do not expect to be hassled with penalty charges. Unless Iceland get this cancelled, you and your extended family will now be former-customers.

first and foremost is to EDIT post #1 and alter it into paragraphs that can be easily read by all , AND to remove any hint of who did what , use words like DRIVER , KEEPER etc
then read the NEWBIES sticky thread
the PPC can try a court claim in small claims court, an MCOL, they have 6 years to do this in england and wales, where they have to convince a judge that they have a valid case
you can and should defend yourself , based on legal arguments and possibly some of what you put in post #10 -
Hi and thanks for your quick responses. Please excuse my style of writing English and writing was never my strong point.
So basically as it was a company van I had no choice but to appeal this is my name otherwise I can only imagine that excel would be harassing my place of work who would of had to admit who the driver of the vehicle was anyway.
So excel have said as a goodwill gesture they will accept that I pay a reduced fee of £20 under these circumstances. I find it funny how they are happy to reduce it by £45, it's seems to me that are just trying to get whatever they can maybe?0 -
you are correct , they can and will try to extort money , even if its only £20
please edit post #1 into paragraphs like your last post0
