eBay whilst signed off sick from work - is this allowed??

    Have you actually any intention of going back to work there? As some situation at your place of work has apparently caused your illness, this seems unlikely to me.

    It would appear that your best course of action would be to instigate your employer's grievance procedure or resign and start a case for Constructive Dismissal.

    You know its not a 2nd job - its just a personal thing you do - so its none of their business. When employers spend your time at work "having a go" - then that is not conducive to thinking in a calm,logical way outside work. They've probably been playing mind games with you - and thats why you are worrying - not because you actually really do have cause to worry.

    Just do the 2nd ID route as a precautionary measure - and mainly just to ensure you dont worry about your e-baying.

    Is it usual for companies to write to a person to remind them not to work elsewhere? My concern is that they know about ebay and are covering themselves in case this does go a tribunal, ie they can show you are too stressed to work for them but can handle your own business.

    Obviously ebay is a business if you buy to sell (ie you don't just sell your personal items) and as such will already be declared to the tax man. There may be an adjustment to your tax code to take in the tax due on your ebay business and the fact that you have a non standard code is how your employer knows you have secondary income.

  • What is causing you to be signed off?

    i.e what is the cause of the stress being cited. unless it is specialised to your frm dont risk it.

    A 2nd id is all and well until they find out and sack you

    You cannot just resign and start a claim for constructive dismissal. You need to exhaust the internal procedure first.

    Some people do go back to employers where they have had a bad time, for various reasons. I did, on a different shift and with a different manager.

    A non-standard tax code can mean anything. You employer will have no idea why you have one (if you do). That is between you and HMRC.

    My annual tax allowance is over £12k per year (ie 4 numbers and a letter) and comprises a number of additions and subtractions, but is almost entirely related to one job.

    Some of my colleaugues have negative tax codes and only have one source of income.

    All that your tax code tells your employer is at what trigger point your taxable income starts in order to refer to tax tables and deduct income tax from your gross pay accordingly.

    People have made some really astute and insightful comments here - particularly about the paranoia as a result of recent events, and also about the wording of the letter.
    I am filing a grievance and a complaint of harassment and will certainly exhaust this before I could considered resigning - I have a mortgage & family to consider.
    I'm erring on the side of caution with the eBay until I know a bit more about where my employment is going...

    Family? Could he she sell the stuff on Ebay and not you? You could help of course with minor packaging -wink-etc to keep you occupied. I mean when my sons are sick I do their newspaper routes for them. That's what families are for after all.
