Final Payments when leaving a job

im looking for some advice on final payments.
I left my employment on the 20th April requesting my fiial days were to be taken as holiday as per contract. i was paid on the last Friday of the month. leaving on the 20th am i right in believing that the 28th April this year would be my final pay date, meaning that all deduction and pay should be worked out and be in this final pay, and any corrections to be made in a timely fashion.
My employer has told me that i have to wait till the end of may to get the rest of my pay, i was paid £359. for 14 days work
my rate is 16000 pa
40 hrs a week
8 hrs a day
i work the hourly rate to be £7.69 which should be £861.
i know im owed money if worked it out from the amount ive been payed from the day i started to the day the employment ended.
the company has cash flow problems and are always on stop with mulitple accounts, can they intentionally pay me less than owed?
What i would really like to know is should they be paying me the full amount in the last pay and do everything they can to make the correction in a timely fashion or do i simply have to wait till the end of this month.

Basically yes I'm afraid.
Regardless of the rights and wrongs there is nothing you can do (apart from asking nicely) to force them to pay sooner. If they don't pay within a reasonable period of time you could take action in the small claim's court but that will take time.0 -
im not sure mate, HMRC says this "Try speaking informally to your employer if you’re having problems with your pay. You could also try speaking to your human resources or payroll department, if there is one.
Ask them to explain anything you don’t understand on your payslip or why you haven’t been paid. If you disagree with anything, explain why.
If your employer has made a genuine mistake, ask them to pay you the money you’re owed straight away. You shouldn’t have to wait until your next pay day."
i found this after i wrote this thread not try to disprove what you said thanks for the help anyway0 -
Undervalued is right, you can ask for an earlier payment but ultimately there's nothing you can do to enforce it within the space of a month.0

Yes, fine. Like I said, ask them nicely!
However the problem is if they refuse to pay before next month, for whatever reason, there are no practical or cost effective steps you can take that will change that.0 -
thanks guys, ive been back in touch with my employer, the mistake was they though i had to give a months notice, which would end my employment in may , making may my final pay date, but my contract only stipulates a week if still on 6 month probation, theres not much point in stressing over it. next time ill wait tiil ive been payed, because nearly every company stinks to work for these days.0

I am also wondering where I stand. My wages were £50 shorty this month as paid pro rata. I have worked my full amount of hours 15 for the month my final day is on Sunday 25th June 17 so for the last 5 days I wouldn't be working anyway they have docked £50 out of my wage! Can they do this even though I have worked the full amount of hours? Just because I wrote the 25th as my leaving date I didn't think this would affect my wage! Help I'm so lost!0

It would normally be better to start you own thread for help rather that tack on to an old one that has been resolved.
They must pay you correctly for the number of days you have worked. However, does your pay vary for month to month, as obviously the number of working days can vary, or do you normally receive one twelfth of your annual salary each moth regardless of the number of working days? This can complicate the correct calculation when leaving.
First step is to ask your employer (nicely at this stage!) for a breakdown of their calculations and, if necessary, seek further advice and take it from there.0 -
I get paid £320.14 per month always then any overtime is added hourly. I work every other weekend so I have worked my full hours. There calculation was 320.14/30*25 I'm guessing that's the 25 days employed out of 30 but I worked all hours required I just did put my notice of leaving as the 30th :-(
Sorry I couldn't figure out how to start a new thread 0 -
I have started new thread xx sorry xx0
