  • Hi I initially signed up with Virgin Money in 2009 and they transferred my account to MMNA. PRA Group taken over my £10,981.64. After reading around I have requested Information Section 77-79 Consumer Credit Act 1974. They received my request on 23rd of October and replied on the same day.
    The letter is standard as everyone else saying here. They returned £1 Postal Order as a goodwill gesture ;).

    I am bit concern about the attached document which outlines even they don't have a CCA copy they can still enforce it.

    I wrote saying I would not pay until they answered my CCA request, PRA Group confirmed back that it was unenforceable. The amount is £9750.

    Next question:
    do I go straight in an offer a full and final settlement?
    do I not pay anything monthly then offer full and final after a few months?
    do I pay a small amount each month (say £25) then offer full and final?
    do I not pay anything at all and see if they sell it on again?
    is there another option I have not thought of?

    Anyones thoughts based on knowledge or experience are appreciated. Thank you.

    Walk away, and thank your lucky stars that they are incompetent.

    If another debt collector contacts you, simply send them a copy of the PRA letter confirming unenforcability, they will scuttle away and you wont hear from them again.

    Although irrelevant as I never intend to need a good credit rating (I am debt free apart from this default on my account), but I am curious as to what happens to the credit file. Did I read somewhere that this will drop off the record after 7 years if no further payments are made?

  • I can't say either way about a debt 20 years ago. But PRA have been great with me, especially as I requested to speak to them via email.

    Although the debt may be unenforceable, they can still record non payment on your credit file, but this entry will disappear completely 6 years after the account defaulted.

    If a clear-ish credit record is important to you, then a settlement offer would maybe be appropriate, but as you say your not too bothered, I would just accept the good luck that's been bestowed on you.
