My Employer has over paid be and now taken it all back without warning.

Hi there,
I need some advice regarding my employer, I have been on long term sickness since the end of March 2017, in which my employer overpaid me, unbeknown to me. I waited to receive my SSP from them this month, only to find out that they had 'clawed back' my wage from this month in order to balance out my overpayment. I thought this was odd and questioned HR, a letter was sent to the branch I work in, but not forwarded on to myself, I am sure the employer must have your permission to take all of your wage. I am fine with repaying my overpayment, but not the fact that they have left me with no money to pay the rent, bills and to be able to eat. I would love some advice off anyone,

    I'm afraid that the answer to this is yes - they can take back money owed from SSP. But I am slightly confused by this - you've only been off work sick for three/four weeks? Is that correct? How much can they have overpaid you by in that period of time, and why didn't you notice? Have you been paid your normal wages? Because people normally know what their sick pay entitlement is, so it would be helpful if you could explain how such a large overpayment occurred.
  • Hi - Yes, I have been off due to sickness since 23rd March 2017, which was my payday. We are paid on 23rd of each month, so I expected sick pay in April, I have never actually received a pay slip since I have worked there, I just know how much I get paid each month, so this month, I expected to receive sick pay, however, this has been taken from me as I have been overpaid. I didn't notice because I got paid the amount that was due to me, as every other month.

    Sorry, but I don't understand your explanation. They paid you a full wage by accident. But you knew that you were only getting sick pay. So you presumably have that amount of money left that you didn't spend because you didn't know you had it? I presume that the overpayment was for the last week in March, and the payment on 23rd is for the full month? What I'm struggling with its what the overpayment is for that entails taking the whole of your sick pay for a month - that's a lot of money!

    Statutory sick pay would be just over £360 a month. Could very easily be a weeks full time wage they've clawed back.
