IPO and IPA

Hi guys busy completing a form to get assessed. I have went back to work part time and was honest with the of and informed them. The new form is scary and hope I don't have to pay it. Basically I come out with £1000 a month I pay childcare and contribute to bills and rent but hubby pays more has his own debts and 2 previewis children and we have a baby.

If they make me pay an IPA and don't agree with the amount can I ask to go to court so I can put my case forward ?

I'm not trying to get out of it and I will agree to pay something back but it's where they might say well hubby should pay more than he does which will affect his payments for debts and other children

    No one can make you pay an IPA - It is an agreement between you and the OR. If an IPA cannot be agreed then either you will not be part of an IPA or the OR can go to court to attempt to obtain an IPO (same as IPA but imposed by the court) IPOs are very rare.
    All circumstances must be taken in to account, your husband is not bankrupt so he can pay his own debts and costs in full. Any IPA must come from your income not his.
    You should post up your SOA on here for folk to look at.

    There is a new form and it says all household costs which is fine but how do they know what I pay towards them The of said she will share out the total household costs which didn't make sense as I pay for some things and he doesn't. Say are total household bills come to 2000 childcare and previous kids included I'm sure she sounded like based on my previous income and expenditure as I was on maternity leave she said I paid 26% then I said yes but things have changed.

    I hope this makes sense.


    I am bankrupt just come back part time from maternity leave I told the of this as wanted to be honest.


    They didn't take a ipa off me due to maternity pay which has left my hubby in more debt so I had to come back early.


    I'm scared out my wits incase they expect me to pay massive amount back im happy to pay a small amount back.


    When I was on maternity leave my official received said I was paying 26% towards the household but I said surly now my circumstance have changed my hubby has his own debts and 2 children from his previous marriage and we get them 2 time a week to stay and then extra during holidays.


    hope I have done this correct. I havnt included his debt or his car lease amount of £150.00 per month shall I do this again?

    Maybe the experts can advise. Would it be better for OP if her husband declined to give his earnings etc and OP's soa was based solely on her income and expenses including half the household essentials?

  • Thanks debt doctor. So if I think if she says IPA should be this much I don't have to agree and can go to court and state my case if I have too. I been to cisterns advice and gonna help me complete figures and form on iPoq
