Doctors note rules

I had an accident at work which resulted in my doctor giving me a 2 week "sick note". After the first week I received a phone call from my HR dept asking if I would be open to returning to work to do some light duties. I knew exactly what the light duties were because I was the only employee that was trained for it. I then find out that at least 3 or 4 people had similar phone calls while off. Apparently they try to get employees to return to work before 10 days so as to not to affect R.I.D.D.O.R. Is this breaking employment law ??

    I would have taken the light duties and been pleased to be offered them.
    Others wouldn't have and would have remained in the sick.
    You were given an option. Not forced.

    Not sure of the significance of 10 days...
    Over-seven-day injuries to workers

    This is where an employee, or self-employed person, is away from work or unable to perform their normal work duties for more than seven consecutive days (not counting the day of the accident).

    Note from the above the information about being unable to perform normal duties - bringing individuals in to perform duties not normal to their function many not benefit the employer at all.

    A report must be received within 10 days of the incident and for accidents resulting in the over-seven-day incapacitation of a worker the enforcing authority must be informed within 15 days of the incident.


    Is there a union presence, if so perhaps the time is overdue to be having a word with the H&S rep.

    Riddor is 7 consecutive days excluding day of accident but including weekends and rest days so not sure about significance of 10 days.

    If over 3 consecutive days need to be recorded but not reported.

    RIDDOR relates to your ability to do your usual duties, not whether you are physically in the workplace or not. If you are unable to do your usual job because of a workplace accident (regardless of whether you are in work and undertaking light duties), it could still be reportable - depending on the length of absence.
