Should I Get Paid?

Hi there,

This is my first post to the forum but I'm hoping someone will be able to help.
So a couple of weeks ago I started a new job however it was the exact opposite of what I expected it to be. This morning I went to hand my notice in - my contract states employees have to give one weeks notice - however the manager said because it was a trainee role and I was still on probation I didn't have to work notice as I would just be taking up other peoples time in the office so I was told just to leave there and then - literally 5 minutes into my shift!
My question is will I still get paid for the time that I worked? I worked Mon-Fri week beginning the 27th March and Mon-Fri week beginning 3rd April. I had Monday & Tuesday off this week but worked the Wednesday so should I still get paid for those hours worked?
The only issue I have is that I wasn't on the company payroll. I mentioned it to management when I started and they said they'd get it sorted however nothing ever got sorted.
Should I contact them and ask about it? Am I entitled to the pay as I did attempt to work notice but was told not to?

Any help/advice/info would be much appreciated!

    Yes the time you worked you should get paid for, your entitled to it.

    Definitely chase up the issue re payroll, as I say your entitled to it, be polite about it, could get done quicker.

    You should be paid for all the time that you have worked, as well as for whatever the notice period stated in your contract that your employer has to give. If you don't get it you'd have to consider whether it's worth the effort to take them to court, if it gets to that point I'd suggest you come back here for more help.

    Īif they decide that youvdont need to give notice then they are ineffect stopping you from earning that week's money, therefore they have to pay you for that week.

    That is correct but they may well argue that the decision to leave there and then was mutual. However if the OP stands her ground, as she was prepared to work her week's notice and the firm wouldn't let her then she must be paid for it.

    Also, she will have accrued 1 to 1.5 days holiday. Assuming she has not taken any then they must pay her for that too.

    Many thanks for your advice, some really helpful information given.
    How would I go about mentioning it to them about getting paid, does anyone have any advice on how to go about doing so? It would most likely have to be done by email as that's how the done their communication in the workplace.
    I feel quite anxious about doing it as I think I really annoyed the manager when I left this morning, to the point I never even got 'bye' when leaving the office, I'm not sure how they would react with regards to me asking for payment, even if I am entitled to it.

  • Yes you should be paid.

    Just drop them a friendly and short email with 'on reflection I think you need my bank details', how would you like to receive.

    You will then maybe find out if they do or don't intend to pay.

    I have a letter I used which got results one time or another which I'm happy to share (although fortunately I had managed to give my bank details over beforehand in that situation and only had to contact once payday or not passed) I wasn't so lucky last June when in similar circumstances started job, wasn't asked for bank details then I quit - I didn't pursue because I was more embarrassed and didn't want any further dialogue but as you were asked to leave then you definately should.

    I definitely will peruse this, I've just been thinking there the person I need to contact doesn't work Fridays so it'll probably be Monday I'll have to message them - hopefully they won't be as angry with me by then!
  • Good, I also had another thought for you and the same did occur to me at my time - that is does this employer know where you previously worked or has your home address - you could find a cheque turns up there. In the absence of bank details taken.

    I'm sure they will have calmed down and be prepared to do the right thing, been though many situations which have resulted in a payment no matter how panicky at first it seems x
