Mortgage Fraud Advice

We live in a house split into two flats. We own the ground floor flat and someone else owns the upper flat, we share the freehold with the person who owns the upper flat. The person who owns the upper flat is renting it out to a family, he has a residential mortgage which he fraudulently obtained telling the mortgage provider that he lives at the address. In fact, at the time of the mortgage application, the tenants had already been there for a year. The mortgage company is the Skipton, does anyone know what they will do. This is not a case of an accidental landlord. He fully knew he had tenants on the property when he applied for the residential mortgage with the Skipton. We tried to speak to the Skipton but they wanted us to give too many details.

    What has this got to do with you?

    This sounds like a problem between the landlord and the tenants.

    If he has lied to the lender has he got landlords insurance ?
    Is he doing a gas safe check every year ?
    Does he look after the property ?
    What would happen if the tenants caused a fire which burnt down the whole property.
    How many people live upstairs ? Overcrowding ??
    Has he declared this income to HMRC

    So I ask again what business is it for the OP, all of the above is for the Owner to deal with, can the OP buy the insurance? can they do the gas safety check?? Can they do his Self assessment?

    Whether the tenant or the Owner burnt the property down, the OP would need to claim anyways through insurance.

    Many owner occupiers also do not look after the property. Nothing we can really do about that.

    The OP's insurance would pay out, just as if an owner occupier (who rarely happen to get gas safety checks) had caused the fire

    Usually a property is insured by the freeholder where it is split into leasehold flats.

    The insurance will normally permit letting and sub-letting so the idea of "landlord's insurance" doesn't really apply where a freeholder is insuring a block of flats.
