Bit of a strange one, can anyone help.
10 years ago I bought a house with my now ex boyfriend, we split up and a document was signed and returned to the mortgage company to remove my name, now as far as I can make out our mortgage was then sold to another company and my name remained unbeknown to myself at this point on the mortgage.
Fast forward 10 years, when Myself and my Husband along with our bundle of joy are looking to buy our first house and I discover my name is still on the mortgage and land registry of the said property, Mortgage company are unable to just remove my name, tried to contact my ex and explain to him as id been advised by a solicitor for him to remortgage the house in his sole name or even remortgage the house in his and his wife's names (Yes my name is still on the mortgage and his wife is happily to live in the house he still legally owns with me?!!) (Nothing queerer than folk ay) but he isn't playing ball, and now to make things even more complicated he has now put the property up for sale.
Anyway my question is how do I go about getting my name removed and getting a financial dissociation with my ex - Contacting him isn't possible as iv sent him several letters explaining that he needed to remortgage the property in his own name and nothing and the most recent letters have come back to me....

I don't know what document you sent off 10 years ago but you can't simply fill in a form and have your name removed from a mortgage...it doesn't work like that. The mortgage account would have to have been closed either by selling the property or your ex getting a mortgage in his name only or with A. N. Other.
When the property is sold, which appears to be what your ex wants to do now, the mortgage account will be repaid and therefore closed. There are several things you could try such as reminding him that, as a joint owner, he cannot sell without your cooperations and furthermore as a joint owner you are entitled to half the equity unless there was a declaration of trust drawn up that says otherwise.0 -
Hi Pixie5740,
The document was sent to myself from GE money the then mortgage company to remove my name - but they then sold the "file" to another mortgage lender - where it still remains to this day - clearly in the middle of this my "document" wasn't actioned.. In a young (19) naive fragile state I never kept a copy of said document so I cant even refer back to this..
I have already advised him that he will need a signature from myself when the property sells in one of my several letters I have sent to him (one of which he has received as i sent it via Royal mail signed for and he signed for it, I have copies of all these) and I have also presented myself to the estate agents as they were non the wiser.. There was never anything put in writing when I left the property, so even though I haven't paid anything towards the house for 10 years I am in still fact entitled to half when the property sells?0
