just had a CCJ isued against me
hi guys, so i received a letter from the courts about a credit card debt with capital one, its lowell who claimed it and i need some advice, im pretty sure the debt is statute barred as in i have not ackowledged the debt or paid longer than 6 years ago, the last time i paid was a token payment that was longer than 6 years ago
so my question is can i defend this claiming its statue barred, bearing in mind i have 14 days to try figure this all out, i have no idea what steps to take next any help woulds be very greatfull.

Hi,
Firstly, you should really of posted this in the defreewannabe section of the forum, not loans, you will get more responses.
Second, statute barred is a full defense to any court action, so yes of course you can use it as a defense.
You dont have to prove anything, they do.
