  • oh don't do a thing yet. don't admit you owe anything yet. if its from 2001 then it is almost statute barred. MKH are notorious for buying debts at this point. I forget what happens next but someone will be along in a bit with more knowledge. Hang on there! :)

Thanks for replying ... im in a real flap here ...
Thing is i did say "yeah" when the woman asked if i had a capitol one account .. :(
the address she gave wasnt the address i had the account at? does this make a difference? ... She also told me the "client" wanted the full amount to which i said i couldnt pay and then she said she would have to get the
    "account manager!" to ring me!

I really dont know what to do im just glad the number i gave her was my old mob number as reading some of the posts they can be pretty pursistant! ..

what do i do ? (panicing)

  • Don't speak to them on the phone for starters. If they insist - just tell them you want a copy of the original credit agreement to make sure it is your debt. Millions of us have capital one accounts so wouldn't worry in saying that you had an account...

Do a check on your credit report - if its not there then will more than likely be over the 6 year limit on chasing debts - mackenzie hall are one of many companies that buy these old debts for pennies to make their money. Knowing full well they don't have a leg to stand on.

On the phone they talk down to you - like no-one should ever have a debt !

Do a check on this forum for other MH entries and there will be a link to send a letter off to them - with all the legal buff in it about statue barred debts ect. When they ring tell them not to ring again and that you will only communicate with them by way of letter.

All I can say is poor you....as Angel said above, do a search for mackenzie hall on these forums and see how many posts come up

I'm currently involved with them for a one debt that two other DCA's are trying to get off me. I've requested a copy of the signed credit agreement but they keep sending me letters saying they need to speak to me on the phone. So I send one back say 'once again, I will deal with you only by written correspondence so I can keep my own records'. They ignore everything that everyone says. I will be reporting them to OFT, the FO and their trading body and hope that my complaint might be the straw that breaks the camels back and something gets done, there must be hundreds if not thousands of complaints about them.

Sorry I'm not much help, but stick to your guns, don't acknowledge the debt and get some advice from www.nationaldebtline.co.uk who are a font of knowledge in all things money. Here's their factsheet about the limitation act and debts over 6 years.

If however you are not the person named above and/or have information regarding the persons possible whereabouts, then please contact out investigation team in confidence on the alternative telephone number or email address below.

We look forward to hearing from you as soon as possible.

    Yours sincerely

    Victor Richards

MH buy old debts, so see if anything is outstanding on your credit checks (Martin's article under cards and loans tells you how to get them free). If not, then it is probably statute barred, or even belongs to someone else,
If you've have not made a mistake, you've made nothing
